    CRSC Tax Offset Residual Retirement

Hey All, This is kind of technical question. I'll be getting $1600 or so a month from my residual medical retirement ($5650 high 3x 75% - my 100% VA $4044), my remaining longevity amount should be $650 or so. If I submit my CRSC and, let's say, I only get 10% for the tinnitus (I really hope I...

    advice?

I would personally try and challenge the 10% rating with an IMR or something because that's pretty low without seeing your DBQ's. The time to challenge that though would have been earlier on. Have you talked to legal at all throughout the process?

    advice?

So based on your post, you are at the DA199 phase/end of the PEB portion. You should be able to request a VARR at this stage (Veterans Rating Reconsideration). You can also request a formal board at this point. It is definitely in your best interest to do so because the difference between 20%...

Dang that's fast. My NARSUM was signed JUL 21. VA claim closed Aug 5. Still crickets.

AF: Anyone choose Legacy DES over IDES? Timeline?

Alright so here's the thing. Say you get a referred condition for your back. Say your range of motion/symptoms/diagnosis come out to 40% according to the VA Examiner. By rule rule, under IDES, the DoD has to use that same rating, so youre pretty much guaranteed to be rated at the 40% for DoD...

    Med board approaching 20 years?

You can potentially collect CRSC (though if you don't medically retire, you only become eligible when you turn 60). If you medically retire, you can apply and start getting CRSC payments immediately.

    Med board approaching 20 years?

As I said on reddit, start the process now. You'll hit 20 guard years by the time its done and you'll be able to still draw guard pension at 60 while getting tricare/retired status now.

NARSUM Review Strategy | Seeking Guidance

IMR won't do that. You'll basically have to wait for the end and request what's called a VARR (Veterans Rating Reconsideration). Basically starting the process over again. It's difficult to get anything added to your referred conditions before that stage.

    Curious

If you get medically separated at 20% or less, you will usually get some sort of severance. This severance will be entirely recouped by any VA disability compensation you receive. The exception to this is if it's combat coded on your DA199 and there's a blurb on there that states it will not be...

Do I qualify for ABCMR and CRSC?

So if you'd have been separated with a P3 profile, and documentation that said "pending MEB/PEB" and they separated you anyway, I'd say you have a shot. Unfortunately, based on your specific situation as you've described, coupled with the significant time gap, I tend to agree with @d001. I'd say...

    Can anyone help?

Definitely tell that to your examiner, and make sure the documentation is uploaded to the VA ASAP. I was referred for lower back/lower extremities but they connected my cervical spine too based on supplied evidence. It's rare but it is possible to have a condition added during before your NARSUM...

    Can anyone help?

So likely what that means is you are being med-boarded for your shoulder only. If it is found unfit, then the percentage will almost entirely be based on range of motion. Attached is a screenshot of the section of the CFR that will likely relate to your condition. As for your lawyer situation...

    Can anyone help?

You can rough estimate what your DoD percentage will be by looking at your old C&P exams, what your profile says on MEDPROS/IPPS-A, and referencing the 38 CFR (Federal Register :: Request Access). IF at the end you disagree still with your referred conditions, you can request a VARR to...

    Can anyone help?

Lots to unpack here. You are in the guard, so the guard will have to do a local "State" board to determine if you're eligible for continued service (It appears this is the stage you've reached). Next comes the formal board (federal level). Which is the MEB. This is the first level that actually...

Need Help Answering CRSC and Post 9/11 Questions for Medically Retired Air National Guard AF PDRL

So from my understanding, the MAJ Richard star act would do the following; If you medically retire with even 10% combat rating when you get out, you automatically get all of your longevity pension without doing any CRSC claims (and tax free). For you specifically, you wouldn't see any additional...
