Advice On Findings from IPEB?

Hi everyone, my election of options is coming up in two days.

My proposed findings were : 10 % DoD, 90 % VA. Unfit for service with severance.

Background : 12 years of service, Navy.

Advice on my election of options? I don't want to prolong this any longer really but wouldn't mind a higher DoD rating.

Have you consulted JAG? Do you have any conditions that you can appeal to add as unfitting? Is your 10% unfitting condition properly rated? Getting 30% DOD is massive! Not just for tricare but because then if medically retired you can apply for CRSC and any money lost due to the VA offset of your medical retirement can be recouped meaning more compensation than medically seperating. So Tricare for life for you and your family right away and possible additional compensation are HUGE!

To add another unfitting condition you would need to request a FPEB. To increase the rating of a condition that was already found unfit is a VARR and yes you can do both!

I have spoken with JAG already. Its not a combat zone related condition. I'm scared , but I'm ready for a new chapter. Im leaning toward accepting.

If you truly believe that you can get to 30% DoD and your legal counsel believes there’s a path to get to 30% do your future self a favor and go with the FPEB. The timelines these days are quick and may only add another month or 2. You have gone this long in the process what’s another couple months.

Nah, been at the command 55 months + and was supposed to prd last year. I'm content. tired of waiting and plus I will have to continue to work until the formal hearing.

I received my iPEB on the 10th of February and my hearing is the 5th of March

I've been in the IDES system for almost a year now. I understand the fear, and eagerness to just get out and move on. I was going to accept my DoD 10% and VA 90%. Then I realized that the severance, while initially nice, will be deducted from the VA disability until recouped. So I requested a FPEB, and have been able to work with my assigned counsel to get my DoD up to 30%, and submitted a VA Rating Reconsideration to bump my unfitting condition percentage which should bump my VA rating to 100%. I strongly urge you to at least request the FPEB and work with the legal counsel to explore your conditions and options. In my case, it has allowed my family to keep collecting paychecks and maximizing savings to make the job search less stressful on the outside. I understand that not every command is great, especially to LIMDU folks. The payoff is worth it in the end, even if it seems like it sucks right now.

Side note, are you tracking eligibility for VR&E (Ch. 31) and Navy Wounded Warrior?
 
That's a good idea. and yeah, I have eligibility for ch. 31. its just myself and im a e-6. my command is pretty much going to have me work until a new hearing is ready. so a rating reconsideration is not that bad to do. I may consider it. Though Im ready to begin terminal leave and all of that stuff.

Trust me, I am SO ready to retire. I will hit my 16 year mark next month. The relief from just getting that retirement vs severance was worth it alone. Not to mention my child and wife are going to be taken care of with tricare for life as well.

I did TAP a couple of years ago , but plan on doing it again before my new separation date most likely on terminal leave. that's good it will take care of your family too. Since its just me, I'm leaning towards accepting and calling it a day.

The timeline has been horrendous for me. Regardless, I am not giving up.
 
You really should speak with JAG. Its free. I honestly dont see the harm of you fighting for more than 10 percent.

Yes, I did TAP when I originally started the process, because it wasn't supposed to last this long. And as far as working still, yes. I'm at a shore duty joint billet for what it's worth and my command is more than accommodating to any appointments, absences, etc.
