I was rated on the 20th of Sept. 2011 as 100% perm. and during the call the lady from the VA said that I was also found incompetent to handle my Finances, I was not explained what this meant or what this would mean to my life, I can't buy a gun-Felony, I could in fact lose control over my Money-all of it, This is from the simple question, do you handle your finances Mr Taylor? No, My Wife Takes care of all the Bills, But since I have a Head injury they must have used that to claim incompetency. The VA Rep. said during the phone call, we will place your wife as Fudiciary, I said without knowing at the time what this all really meant, That is fine, she said; so you waive your rights to a hearing? I said yes.
I called the 800 # today and asked about the Fudiciary and the Rep on the phone said they are not suppose to call and ask me to waive my rights over the phone, He put in that I wanted a hearing and said they should be contacting me soon.. I am far from being incompetent and the questions that they ask you to determine if you are should not be enough to say if a Vet is or not in competent, this can mess our lives completely up and we should have some choice in this. I did contact my VSO but have yet to hear from them.. I have heard that anytime a mental Determination is made that ends with a 100% rating that they give an Incompetent rating and leave it up to the VET to prove otherwise. Should I push for Competency and risk my claim? I do not really care about the money as much as I do about my freedom.. I have a total of 260% ratings and even if they take off the Head Injury I will still be 100%..
