Adjustment Disorder news

Sorry, you are correct in that I got my NARSUM and 3947, not 199. Yes I am Reserve and I did not "give" them the information that is on my 3947 and I don't know where it came from. When I reenlisted in '06 my first check said I had 22 years in the Military, since I had a 18 year break in service, they had to correct my PEBD. I gave them my original DD214 and I assumed they would fix the problem in IPERMS and anywhere else it needed to be fixed. Now, I have had to give them the 214 again and they are trying to get it pushed through RPAC and personell. I have 3 years active and 3 years IRR on the first and this hitch has been about 3 years active and 4 years TPU. I believe that the first enlistment is important for my records. The PEBLO says, "don't worry about it", which naturally makes me worry. I am guessing my NARSUM will be different when this clears and I will have to deal with the time in service then. I believe you said I should appeal it earlier in this thread. Thanks for all you do.


********** IF you signed your VERY FIRST enlistment contract BEFORE SEP 08, 1980 - then you would fall under the "FINAL PAY" calculation system. This could be a good thing as you would NOT have your retirement calculated under the "High 36" average.

If this is your scenario, watch to make sure you are properly awarded FINAL PAY retirement calculations.

I initially posted this as a response on the DoDI 1332.38 Physical Disability Evaluation 1.2 thread, but thought it was general enough to repost here. We have been instructed to pull every case still in the system, and that includes soldiers on terminal leave, to check if an adjustment disorder was listed on the 3947. If it was, it will be sent to the mental health NARSUM/Addendum writer for them to say if it either acute or chronic; and whether or not it fails retention standards. If it is determined that it is chronic and fails retention standards, a new 3947 will be done and routed to the PEB.
What does that tell me? It makes me think those cases will have the adjustment disorder factored in to the separation disposition. This may affect a lot of soldiers and can certainly mean the difference between separation with pay vs retirement. I would guess the retirement would be TDRL, just as it is in the majority of PTSD cases. So, that is the latest as we have it. That being said, it can change on a dime, and you probably know that. I'll post new information as we get it. This change 2 just came down on 10 April 2013, and was not implemented until a couple of days ago.

Today (28/JUN/2013) I signed my "Addendum" because the PEB said that they needed to know if it was chronic or not and if it fail retention standards... sounds familiar rite? Well my Doctor rewrote the NARSUM and changed my AD to Chronic AD but it was still a "NON-Disqualifying" condition, u said in your post that if it was disqualifying it will go back to PEB. My question is whats gonna happened with mine since it was changed to chronic but is still a non-disqualifying condition??

Same thing will happen to all of them whether chronic, acute or meet or fail. They all go to the PEB. If it didn't change the status of your claim, it will proceed from where it was when this whole mess started. If it did change, meaning it now fails retention standards, then the PEB will consider the rating given by the VA for the adjustment disorder when they separate you. So, in your specific case, you will continue because even though it was changed to chronic, it did not meet retention standards.

Does the Addendum needs the soldier's signature to be sent to the PEB for every type of case? And what is the timeline for the PEB doing the 199 for the CAD cases?

We are being told that yes, every one has to be presented to the soldier and signed with concur or non-concur. As far as the timeline for 199's. I have not gotten a straight answer yet but am working on it. As soon as I get something more than speculation I will pass it on.

Thanks for the information. I was told my MTF had my packet reviewing and I guess writing the Addendum or Memo, that was a week and half ago and I haven't receive any call from my PEBLO with that been said it seems very clear to me that if haven't signed any document this is going to take a while. I'm hoping I can start terminal leave at least in Sept, I hope hear something from my PEBLO this week if not I'm going to be so frustratef.
 
Our MTF has most of ours finished but we are one hell of an IDES team. I hope you get yours done soon.

I don't which team you are in, but I'm in FT. Bragg and they pretty much suck. I hope they finish mine soon too.

I hope you understand why I choose to remain Anonymous about exactly where I'm at. I feel I have much more freedom to be completely blunt about this process, and don't want to incur the wrath of PEBLOs at other MTFs that may have issues. You know how it goes, attack the one that is doing well and pointing out the right way of doing things, rather than fix the problems at your own MTF.

I was retired on 8 May with a rating of 60% VA and 50% DOD, with a second claim open. On 10 June, E bennies showed that my second claim was complete. On 13 June I got the paper work from the VA stating I was now rated 80% VA and 80% DOD. the new additions were 30% for chronic adjustment disorder and 10% for my tinnitus. Money was in the bank that day for the back pay. Didn't even know CAD was holding up my claim till I reviewed my NARSUM. (The one thing they didn't touch or rate me on was my severe sleep apnea.) Today eBenefits for some strange reason has a new claim... #3 for Administrative Review? What is this?

My PEBLO just called me. He said that the PEB just sent my packet back for review. He's forwarding it to a provider for review and the NARSUM write-up. Should see some progress soon! This is on JBLM BTW.
