Admin Seperation during my MEB

BLUF...If you are CURRENTLY underway with an MEB, you cannot be chaptered. Gross misconduct is another story but as mentioned above..it runs concurrently with the MEB and a decision is made at the end.

(I refererance Army only with regards to this info..not sure on other branches.)

ANY form of misconduct (pattern, commission of a serious offense, drug abuse) carries a tentative characterization of service of UOTHC. If being medically boarded, the MEB/PEB will be forwarded to the GCMCA for determination of whether the misconduct was a DIRECT result of the physically unfitting condition. If not, you get the bad paper.
 
Good news. I was just contacted by the doc on my perm profile and they have approved it to start the MEB process. Thanks for all your advice and I"ll continue to update as things go on. Thank you all!!!
 
You command can't impose any UCMJ for members on MEB without evidence. More importantly for those members on a fitness medical profile. See my posting on Administrative Actions for AF members on MEB status AFI36-2905, Chapter 9. Also, file a IG complaint to get them to back off and or congressman or state senators.
 
Can you be admin sep because of ht/wt after you have been found unfit while you are waiting for your ratings? Where in the regs does it specify what to do? I have checked AR 600, but my company cdr says it does not cover unfit unless you get a memo saying you can't lose weight because of the condition.

No you can not be admin sep'd automatically for HT/WT after being found unfit. they can start a dual action discharge rec. but it seems to me that the time for that to go through at the point you are at would be longer than they have.

basically, the CDR draws up the discharge paperwork, it goes to legal for review etc. if its good to go it goes into your file and once the board makes its determination, both options got o the service secretary for approve/disprove. I do not believe a single case on here has ever resulted in discharge due to wt control in lieu of retirement/severance under chp 61.

Now they can make your life a living hell, pull rank/extra duty within profile limitations etc. every other tool available to them under the rules, but they cannot stop a meb and sep for anything other than moderate/severe disciplinary problems.
 
I have an issue similar to draagyn that hopefully I can get some help with. I just underwent a AdminSep board on the 30th of Jan, they voted(not unanimous) to discharge me with a "General" discharge. The charge was for commission of a serious offense by having unofficial contact with a future soldier. There is no evidence of the charge and all the levels of investigation show the claim is unsubstantiated but im still getting separated.

6 months prior I under went a separation physical, during the process medical personnel asked me if I wanted to pursue a MEB because with my ailments I qualify. I told them no because at the time I was adamant about fighting the discharge and staying in the Army. Throughout the process all the different sections told me that if at any time I changed my mind all i would have to do is bring back my medical records and they would initiate a MEB.

My question now is; If I initiate the MEB process, which I did on the 14th of Feb, am I entitled to have the entire process complete before the final decision of the discharge is made? My AdminSep still has to go before the CG of recruiting command, which I am also trying to appeal, for final approval. Who in the COC could stop or deny the MEB process. Any help that can be provided will be greatly appreciated.

As such, have you completed the DoD IDES MEB/PEB process at this poin in time?
