Adverse Action Flag

I went to reclass at ait and for graduation I submitted a 4day I was told by the drills that i’m good. So i went home for the 4 day and got recalled so i requested to speak to the commander and they basically told me no. So i called the BDE commander and told him what was going on and he said submit it as leave and he’ll approve it which I did. I come back and instantly get an adverse action flag, this was on September 5. I was found unfit for duty from the peb on december 9. I keep asking for updates but they tell me “it’s with legal” for months now, so i don’t know what to do because my peblo said the action is suspended until they decide what to do with my flag.
 
what am I reading? medical board and mar2 at the same time? and what kind of flag? they cannot initiate a flag without you sign a counseling form. what the heck?
I'm so confused because I did mar2 to reclass, then started my medboard now I'm at the final stage of my medboard. for the flag, make sure u talk to your CoC to remove after you sign da199, you cannot get your order cut while being flag.
 
Same. I’m totally lost. What was your adverse action flag for? What code? You should have signed a DA Form 268 telling you.
 
that’s my bad I should’ve specified, the flag was for “disrespect of a superior officer” and verbally i was told it’s because i called the bde commander to do my leave.
 
Seriously? If I was you I’d contact the Brigade CDR again and tell him they flagged you for that. This time, just to be cautious, request through your chain of command to use the BDE CDR’s open door policy; they aren’t supposed to be able to deny it and if they do they are disobeying a direct order from the BDE CDR. I bet he’d be shocked to hear this and squash it unless you’re not telling us something.

The good news is that, regardless, this shouldn’t be anything to be too worried about. It sounds like your command is just fucking with you because I hardly doubt any legal advisor would recommend they try to give you an ART 15 or worse. If they do, fight it, no way it’d go to a court martial.

Btw, if you want to PM me your name and your BDE CDR’s name, I’d happily write him and let him know what’s going on.
 
Just having been in command before, I suspect we’re not getting the whole story. I don’t know one commander that would sign off on that flag. Something is missing here.
 
You’re probably right, but I’ve met plenty of shitty commanders in my 23 years of service who were wrought with power. Hate it when CDR’s start playing games with Soldiers who are medically separating.
