ANG dual status technician going through MEB/IPEB

During the last month I have been to two C&P exams as I go through the MEB process. During the week (Monday thru Friday) I am in a Federal Technician status. The issue is both my C&P exams were conducted during the week, I was not put on MEDCON orders during this process (and I did not request to be, I really didn’t know that was an option and my MTF at the Guard base is totally clueless). My question is my supervision is requiring me to take personal time (my sick/vacation time) on the Technician side (civil service) to go to these manidatory appointments military fit for duty appointments (C&P exams). From talking to people going through the process before me I know this is wrong but I need more. I appreciate any advice and thanks for your time.

Monkey64, I work in HR for the same type of situation that you describe, yet I am not your HR representative. There are a few options that are available to you as a 32USC709 technician. If you did not request military orders or split train to accomplish the VACP exams, then your supervision is correct to have you use the leave of your choice that is available to you. I use sick leave most of the time unless I am on AT or other types of military status. When you are a Title 32USC709 technician and not at work you must be on some type of leave status such as; sick leave, annual leave, compensatory time used, leave with out pay (KG) for military purpose, or military leave (LM) and must be approved by your first line supervisor. There is also an incapacitation option, yet it is cumbersome. Please contact your HR Benefits section if you have further questions. Best of luck and thank you for your service.
 
I was blessed, my job site allowed me to attend all appts/required other w/o taking lv. I guess its all who you work for.
