Hello all,
I have come by here a few times in the last few months trying to find answers. Although I have found allot of useful information I haven’t found to much about my exact questions. I am hoping that someone can help me out.

Background-
2001- I PCSed to Nellis. “Spells” started. Went to the Dr around 2002 to see what these spells were. Dr had me give blood and check for Diabetes. It was not Diabetes and was not diagnosed.
2002-2006 – Lower back pain diagnosis as 2 bulging discs and 3 pinched nerves. MEBed and report back to duty with PT limitations.
2007 -2008 – year in Korea, minor Dr. visits for back pain.
2008-2009 – Volunteered for a TDY to the desert, was told my RILO was overdue so was placed on a code 37 (undergoing MEB/PEB). I was denied to go on the TDY. RILO came back report back to duty.
2010 - I went back to the Dr because of the “spells”. I was sent to Landstuhl to see neurology. The Dr had me do a brain MRI, EEG, and some other neurological tests which came back all clear. I was put on Dilantin to try and diagnose to see if I was having seizures. Needless to say I was told the diagnoses would not happen overnight and that since I have never lost conciseness it was a difficult case. I was not coded and was still deployable so I volunteered to go on the next desert rotation. The Neurologist said it should be ok since my job is not a combat job. I started out processing and got all the way to Physical health again. I told them I was on Dilantin and once again they sent me to my PCM. The PCM said I was not deployable again and showed me in the reg where it said an MEB had to be started no later than 90 days after your first seizure. At this point I have not been diagnosed with seizures. In fact the neurologist has told me it might be a type of migraine.

The questions I have:
1) I received my new 469 in April. It is the same 469 for my back but the MEB and not deployable status was added to it. I asked my Dr. and was told that the MEB has not been started because the diagnosis has not been made yet. Is that allowed?
2) Can you change a 469 to say a MEB/PEB is pending even though there isn’t one pending?
3) I PCS in March so I should be starting to look for orders in about 5 months. How it is going my MEB process will not be complete if it is even started. I have read in a personal AFI that a members DEROS cannot be involuntarily extended. Does anyone know how this works?
4) Does anyone have any advice at all? Like most posts that I have read, I am just tired of being in “limbo”.

No there is not currently a MEB initiated on me. I asked the Dr and the RILO office. That’s where my confusion is. I was MEBed in 2006 report back to duty for my back, a total different condition. The reason I was receiving a new 469 was because I am on a permanent profile for my back and it was due for renewal.

Again this is where I am confused. My PCM and RILO office are saying there is no MEB initiated against me. What seems to have happened is the day my PCM said I was not deployable they went in and changed my 469 to state that a MEB/PEB was pending to take me off deployment status. I’m just not sure if that allowed when there is no MEB being initiated because there is no diagnoses.

Any idea if there is somewhere else that is in writing? I found this in 36-2110. I am not sure if an un diagnosed condition would fall under not PCSing or not.

"NOTE: An AAC 31 or 37 does not preclude an Airman from separating or retiring; these personnel actions must be monitored by other means. DEROS will not be involuntarily extended for medical reasons. When appropriate medical authority determines an Airman is not medically cleared for PCS, and AAC 31 or 37 is updated, the airman is directed to remain in place and the DEROS will be allowed to expire. When Airmen are medically cleared for PCS near or after their DEROS, the MPS advises the assignment OPR, with information copy to HQ AFPC/DPAMM and HQ AFPC/DPAPP, of the circumstances and requests assignment disposition.

What outcome do you want?

I would like to stay in. But to be honest I am kind of tired of getting the run around. If I was offered medical retirement I would consider it.
