Can someone please tell me if I could appeal conditions that were not added to my 3947 from the MEB phase. some are considered unfitting and other 5 are fitting. My legal counsel said I should be able to but I just don't trust him. When I got my IMR I was fine it said add all the conditions I was asking for on my 3947. Then I receive my 3947 and the doctor that signed it said it is final and it stands. So I am confused on why it won't get added to my 3947 if I clearly have medical records, IMR stating to add it, medical letters that I sent up for my appeal, and C&P exams for these conditions. How can this even be possible? What are my next steps to get this fixed.
Did you write a statement of views to submit to the PEB? If so, maybe the will consider the conditions and will add them as unfitting. I had to do this because my PEBO did not submit my additional records and DBQs to my IMR.
Dang! Even with documentation stating that it occurred in the line of duty? Those dudes are a bunch of douche bags. Appeal the hell out of it. Fight for what you know it should be.
