Hello,

Any soldier who is read a company or field grade Article 15 has an absolute right to consult with a defense attorney before deciding whether to accept the Article 15. Your legal brigade does not administer Art 15s, unless things have changed greatly since I retired.

Commanders must Flag Soldiers for adverse actions including: Article 15, UCMJ,or civilian criminal proceedings; inefficiency or misconduct; initiation of non-punitive action; and AWOL status.

The Office of Soldiers’ Counsel (OSC) provides legal assistance to Soldiers undergoing the Army’s Disability Evaluation System (DES) from the initiation of a Medical Evaluation Board (MEB) through final review by the Physical Evaluation Board (PEB) and separation or return to duty.

See JAG.
