Just a little background, I am an M-Day soldier in the Michigan National Guard(since June 2015). Previous to that I was active duty from Dec 2010 to June 2015.

Feb 2020- I am informed I have arrived at a MRDP as well as considered a Non-Duty Related (NDRPEB) case because I have no LODs for my injuries, even though my injuries are sustained while Active Duty. I fight this at every step and elect to fight to stay in. I am aware I will be found “Unfit” but I am simply trying to let the board know at every step my injuries ARE in fact duty related.

May 2020- Unit reaches out to me to let me know my NDR-PEB is moving forward and I should get my affairs in order to be discharged within 60-90 days. At this time I also submit an “Intent to File” through a VSO.

Aug 2020- The informal NDRPEB meets, finds me Unfit as expected. I submit a final rebuttal that I should be going through the IDES process along with final documentation from my civilian GP that my issues are duty related.

Sept 2020-Oct 2020- Radio silence.

24 Nov 2020- I am contacted by my unit Admin NCO that, after an in depth records review, I will now be going through the IDES process.

Dec 2020-Feb 2021- Radio silence

22 Mar 2021- PEBLO at Camp Atterbury reaches out to schedule initial counseling

23 Mar 2021- PEBLO initial counseling

24 Mar 2021- Mandatory legal brief from Soldier’s Counsel

31 Mar 2021- VBA Case Manager reached out for mandatory brief.

2 Apr 2021- Sent in 21-686, sent to JBLM same day

6 Apr 2021- QTC calls to schedule C&P exams

18 May 2021- Last QTC exam

26 May 2021- MEB Findings forwarded to me by PEBLO. Of my 3 referred conditions 2 are considered to not meet retention standards.

27 May 2021- PEBLO Counseling on MEB findings and Form 5893

1 June 2021- Office of Soldier’s Counsel appointment. Attorney suggests I “Concur” and ballparks my ratings and disposition. I return Forms 3947 and 5893 to my PEBLO. PEBLO informs me my packet has been sent to the PEB and expect a disposition in 60-90 days.

9 June 2021- Routinely checking my bank account, I see a large deposit from the VA pending.

10 June 2021- Reached out to both my VA Case Manager and Soldiers Counsel to see if they can shed some light on how my VA case moved through so fast, as I have not received my decision letter or any correspondence from the VA at all.

Will update as things happen.
I just want to say that if you’re in a bad spot regarding this process, whether that’s a unit that isn’t doing the right thing or your being made to go through a NDRPEB, even though you can prove it’s service related… keep fighting for what you’re legally and ethically entitled to. I thought it was a wrap last year in August and look at my situation now. Turn in everything you can to make a strong case for yourself.

That's not a bad timeline so far man. Sounds like the VA is moving super fast for you. I mean after getting your ratings back from the 18th and then seeing something pending by June 9th? That's awesome. Did you try to calculate the pending amount from when you put in your intent to file? Or check your benefit letters on E-benefits to see if it gives you a percentage yet? Either way sounds like your moving pretty dang fast.

I did hop on E-Benefits and check my percentage. Of my 9 claimed conditions, 8 were service connected for a VA total of 90%. I am in the IPEB step right now, so I don’t know for certain what my DOD % will be, but if they use the VA ratings, it should be 60%. We’ll see what happens.

Congrats, that is great. Any chance you could write out the referred conditions to get an idea on what the rating is looking like?

Nice I would like to fight mine. My process started may 2020. They told me I was going to be not inline of duty, I was also told thats how all dual status technician medical work. I told them it was ILOD at medical and they felt it was also and I had records. I pushed pretty hard for an ILOD. It went to NGB for 5 months and was denied. So mine transition to not inline of duty DES that was in February. Been waiting for fit determination ever since. How did it work for you I'm confused did you go though NGB for a formal ILOD or did some other intently call it that? The whole dam process is confusing to me and takes an insane about of time to complete. I had the same thing happen every claim with VA I receive money in my account before the paperwork it's crazy but a good thing other wise your waiting on the denied paperwork.

Long story short, I was found unfit and was told I’d be out “soon”. Then nothing happened and they said basically it got to “Big Army” and they kicked it back and told them to put me through IDES.

Any updates on your timeline TerminalSPC? I started my board in May and as of the 29 June my stuff is at the PEB. I feel like mine is moving pretty fast but everyone says the PEB and 199 areas are the worst part of time in this experience. I feel bad to those who had to wait for in person exams due to covid. I know that put a lot of mental strains on those timelines.

Nothing. Sounds like I’m in that 199 time period where it’s just silent and then stuff starts happening real quick.

Wanted to close the loop on this discussion. Just as an FYI, I was checking my iPERMS the other day and my 199 from the Non-Duty Related PEB was in there… or so I thought. In place of the findings, there was a memo dated for 5 July 2020 to terminate the board as I was found to have duty related conditions. The funny part is I was not told I’d be going through IDES until 24 November 2020.

EDIT:

14 Jul 2021: PEBLO reaches out via e-mail to inform me we are still playing the waiting game. Reconfirmed my packet submittal to the IPEB on 1 June and the 60-90 day timeline. PEBLO unaware I had already reached a disposition from the VA regarding service connection and my disability rating. I responded back that I was in receipt of backpay dating back to May 2020 and pay from June 2021, deposited 1 July 2021.

EDIT:

30 Aug 2021: Received IPEB findings. Unfit. 60% DOD, 90% VA. PDRL. I have my counseling with my PEBLO tomorrow after which I’ll schedule with Soldiers Counsel. I don’t plan on fighting the findings at this point.

06/29/21 is when i turned in the NARSUM and was forwarded the same day.

I am guard and mine was sent to camp Atterbury. I’m not sure why mine was quick. I can tell you I had 5 conditions referred and only 3 were determined by the PEB as unfit.

The only thing I could think of is if someone has more then 3 conditions and it takes longer?

I’ll post more on the timeline thread I created for the final bits of the process. Retirement services, etc. as it goes on.

13 Sept 2021: Received my retirement orders, retirement date is 12 Oct 2021. Called State RSO and left a message to set up a time to do retired pay and SBP counseling
