Just wanted to post my timeline. I am E8 Army Reserve 28 years (6 AD).

PEBLO and Legal out of Camp Atterbury(CAIN)

Timeline:

PHA May 2023..eventual P3s and permanent profile between 2022-2023

1/10/24 MEB referral for PTSD, lumbar degenerative disk disease (DDD), neck pain, bilateral lower and upper radiculopathy. Total of 5 conditions referred.

1/19/24 PEBLO/legal briefs

2/9/24 MSC brief claimed and referred conditions-9Feb24. Decision point: Do I go to IDES with existing VA ratings for my referred conditions? Or do I ask MSC to re-evaluate conditions as supplemental for increases. Based on posting questions on this forum, decided to get re-evaluated. Scary time since I was already at 90% combined. PEB forum gave me courage to go through full blown IDES. Submitted exams for referred conditions and 8 others.

22-26 Feb 24 VA C&Ps-completed and downloaded from Tricare online

3/29/24 NARSUM received from Atterbury MEB. Removed my P3 profile for neck and upper radiculopathy. MEB conceded PTSD, DDD and bilateral lower radiculopathy.

4/19/24 OSC Legal sends appeal to add neck and upper radiculopathy

5/1/24 MEB Appeal Response states neck/upper nerves are still “meeting retention standards” despite commander memorandum and DBQs.

5/2/24 NARSUM forwarded to PEB. In the PEB PHASE.

5/22/24 VA.gov shows a “pending claim” in preparation for decision phase.

Please let us know when you have more results.

Also, for conditions found unfit by the iPEB or FPEB you can request a VARR so if the VA rating is lower than it should be you can appeal it. When you get out if the VA were to lower any ratings you can appeal it. I have yet to see anyone choose IDES and regret it. Hopefully your case will bear the same fruit as others. At the very least you have chosen the newer system with more built in protections and once the process is over with regard to PDRL conditions they are permanent which has a much greater implication for your financial future. You are giving yourself the highest upside and any downsides would be in extra work to appeal VA ratings later on.

Your service profile and conditions are very similar to mine. (CAIN)

Given your timeline, I really feel there is something not happening as it should with my case. My exams were completed OCT 2023. Last contacted PEBLO a week ago to inform him of upcoming treatment. Was told I couldn't submit more treatment records as my case is now at the MEB board for review. I'm not sure if I should have had a NARSUM complete before the review, or if the MEB review will complete the NARSUM. Either way, I'm coming up on 8 months from completion of exams with no NARSUM.

That’s why we’re here bro..

1. For me, my OSC counsel went over my DBQs line by line to make sure they were properly assessing my conditions and she gave me estimated %s. Ask if your counsel can give you some estimates.

2. Keep going to the doc. You’ll know based on the already completed VA DBQs was not properly assessed. Get it all documented.

3. Once you get your NARSUM called legal IMMEDIATELY for appointment. MEB takes their time but will rush you to make an election.

4.All the ongoing care can be used later at reconsideration or to open reconsideration.

6/8/24 VA.GOV app and site shows IDES Claim as "closed" 100% combined

6/21/24 PEBLO sends me DA 199 PEB Findings. PEB Finding states, "SOLDIER IS PHYSICALLY UNFIT AND RECOMMENDS A RATING OF 100% AND THAT THE SOLDIER'S DISPOSITION BE PERMANENT DISABILITY RETIREMENT" also says "V1/V3-Yes direct results of armed conflict". For each referred condition, column a. "Incurred or aggravated in the line of duty in a duty status," shows "Y" for ALL of the referred conditions.

6/22/24 Making appointment with OSC Counsel to review 199 elections

QUESTIONS:

Q1: 199 states I will receive 75% of base pay. I did the DOD Military Disability calculator, inputting years of service, points, etc. According to the calculator, I will receive $5100 (E8 with 28 yos). I currently receive VA $4700 payments (with SMS-S for over 160%). Does that mean I will receive DOD 5100 minus VA 4700=400. So I will receive $400 from DOD as non-taxed due to V1/V3?

Q2: Although 199 gave me 100% (MH), my preferred condition, which was my back DDD (40%) and radiculopathy (20% for each leg, totaling 40%), was not added to the 100%. 199 says, "100% combined with 40% = 100% combined with 40% = 100%." SHOULD I EVEN fight to make sure it looks correct?

Q3: I am in the reserves. To enroll my family in Tricare (the family is already enrolled in DEERS), should I ask my unit to give me the time to go to the base to enroll? Is the enrollment for Tricare done at the DEERS office OR the Tricare office somewhere or online?

Q4: When can I start to apply for CRSC?

Your VA comp is tax exempt. The $400 paid by DFAS is tax exempt too since V1/V3 is yes on your DA199. The awesome part is that if your VA% went to zero you would still received $5,100 a month all tax free from DFAS. Its good to accept VA compensation because you need to accept if if you want CRSC.

The DA 199 shows all my referred conditions as "stabilized=Y" and the wording on 199 states, " THE BOARD FINDS THE SOLDIER IS PHYSICALLY UNFIT AND RECOMMENDS A RATING OF 100% AND THAT THE SOLDIER'S DISPOSITION BE PERMANENT DISABILITY RETIREMENT."

Look next to each condition on the DA199. It answers question for each condition such as V1/V3 yes or no, PDRL or TDRL.
 
Only the condition with 100% has V1/V3 code. Others don’t have the V1/V3. Each conditions doesn’t have a separate PDRL or TDRL. But it had a block that says “stabilized” for all the conditions.

Okay nice! So the D section it states yes for each condition. K that's good. Then everything is final and won't change:)

Q1. Yes no taxes. VA is tax exempt and your chapter 61 is tax exempt. So if your chapter 61 pension amount is greater than your VA compensation than the difference left after the VA offset will be tax free.

Q2. Do you have a DFAS online account? If so, you are all set. The MyPay website that you use for LES's is the same for retirement. There is a drop down box where you can switch it between your guard pay and retirement pay.

Q3. Make sure to upload your DD214 to your VA claim so that they can finalize it ASAP.
 
FINAL update:

27 Jun 2024-Returned signed 199 to PEBLO (concurred)

28 Jun 2024-Iperms uploaded with PEB Findings AND PDRL Retirement Orders. Faster than I expected.

3 Jul 2024-Completed application for retired pay.

9 Jul 2024-PEBLO send me copies of retirements order and signed 199 which were already available via iperms.

19 Jul 2024-DFAS states my retired account paperwork received and in progress to be completed sometime mid Aug

28 Jul 2024 (last day officially military)

29 Jul 2024 (OFFICIALLY RETIRED! PDRL)

31 Jul 2024 Updated DEERS brought CAC and retirement orders. Couple of hours later called Tricare (Humana) and enrolled my family into Tricare Select.

Since it’s medical retirement there’s NO yearly premiums for Tricare, still pay usual co-pays etc.

Thanks again for everyone on this board!!! I added this last piece in case anyone wants to know the timeline after the big fight with PEB is over.
