BCMR/BCNR Question

Hello, my name is Jason. I hurt my back in Iraq in 2004 and in March 2006 I had surgery on my neck C-6 C-7 with a fusion done. I was rated 10% and MED boarded out in July 2006. Since being out I am now receive 70% from the VA but of that my neck is only 20% I believe. Since being out I have been diagnosed with PTSD and receive 10% from that. Most of my rating comes from Sleep Apnea disorder.

Question 1. Can you do both BCMR/BCNR or can you just do one?

Question 2. If I can only do one. should I do the BCMR because of the PTSD?

Question 3. Will this affect my VA rating in any way?

Question 4. If I am medically retired, can I get money from that and the VA at the same time?

Board for Correction of Military Records (BCMR) is for Army, Air Force, and Coast Guard. Board for Correction of Naval Records (BCNR) are for Navy and Marines. So, you would apply to whichever board is appropriate for you based on your service. (I am wondering though if you are confusing or mean to ask about Physical Disability Board of Review (PDBR)? PDBR can be done for conditions that were either not rated correctly or were addressed by PEB.

Question 2. If I can only do one. should I do the BCMR because of the PTSD?
Yes.

Question 3. Will this affect my VA rating in any way?
No.

Question 4. If I am medically retired, can I get money from that and the VA at the same time?

Only if you have 20 or more years of service or if your conditions are combat related.
 
You really need to figure out what the VA initially rated the condition the PEB found unfitting. If 30% or more, I would go to the PDBR.

Next you need to figure out what conditions your PEB considered. Anything considered by the PEB can be reviewed by the PDBR.

Anything that was not covered by the PEB can be taken as a separate action to the BCMR/BCNR.

The PEB found my neck being unfit for duty. The VA rated it at 10% when I first filled and I don't think it is more than 20% now. So I can do both PDBR and BCMR? If I can do both I am going to file for both. Ifso, can I do them at the same time?
 
You can't do them both for the same condition. The BCMR can do everything and the PDBR is limited to PEB considered conditions.

Oh ok, would it be better to let the PDBR do the initial condition or would it be better it the BCMR does the PTSD and the Neck together. Would I have a better chance of getting a higher rating if it were two. Because the VA only game me 10% also for my neck. Now I have all kinds of problems with my neck that I didn't have back then.

It was my neck where I had surgery in the Army. I have a spinal fusion and have hardware connecting my C-6 and C-7. I received a 10% disability from the PEB. The VA only game me 10% for it also. They only take the range of motion in to consideration. I have nerve damage and also a lot of pain. I got a lawyer to fight it with the VA this time.
