Changes to PEB findings?

Last month I signed my 199 and agreed to everything. My PEBLO told me that I should hear from transitions in about 3 weeks and if not, to contact her and she will find out what is going on. Today I received a call from my PEBLO asking if I could come in today and go over the changes that were made to my 199. Apparently there is another board after the PEB that ensures that the 199's have everything on it? Anyone know what this "new board" is? Is it even legal for them to change my 199 after I sign it?

It was PDA HQ, ensuring everything was correct, seems like they found an inconsistancy and it may benefit you. Keep us posted!
 
I was rated 20% for back conditions by the Army which of course got me a severance package. The VA gave me 10% for siatic impairment and I'm thinking the change will be them adding the 10% to what the Army gave me. But then again, I was rated at 30% for headaches but my report for all my ratings said I had been diagnosed by two VA doctors for TBI and I had credible information for the diagnosis but not enough medical history. Man, I just wish this was over alread.
 
I guess the biggest question I have is can I disagree with the PDA's findings? I've got everything planned around a severance package and that suddenly changing would be pretty stressful

That is an unknown, when you have your brief with the PEBLO you can ask them for the best answer, please post what the answer is just for informational purposes for others.;) Thanks!
 
Well they added my siatic to my 199 and now I am retired. I asked my PEBLO if I could deny and change it back but she was too busy giving her opinion to me about "bene's".

Wow that was epic fail! did you get TDRL or PDRL?
 
PDRL. They screwed up my compensation worksheet as well, NOT taking into account that I am promoteable and they didn't give me explanation on WHY changes were made. Also, my biggest question was I was 20% DOD and 60% VA before the change, now I'm 30% retired, so what happens to my other percentages? Right now as it stands the only thing she could tell me was I would be getting $763 a month in retirement every month. I asked her WTF happened to my other 50% and she told me to go talk to the VA. I'm pretty pissed off at this point, being as I originally got my P3 in OCTOBER 2010 and I never appealed anything, never added anything that wasn't in my medical records OR drug my feet on anything, and it's taking this long.

I just want to know if I could change it back and if I can't, how is the other 50% of disabilities going to play in and how much money am I going to get every month. My unfit injury is combat related and I really wanted severance because my wife works for the FAA and we already have great medical insurance. Retirement isn't worth it for me.

Sorry man, but retirement is always worth more than the Severance in a few years. I havent gotten either yet(Waiting on VA reconsideration). Would be okay with the severance and kind of want it for short term security. But I know the retirement is a better investment.
Your wifes insurance isn't a for sure lifetime coverage brother.

That is another good perspective! That is what I was concerned about for a few months too.

I hear you man, we all have our different views on what would be best four our individual situations though, you know? Plus, it's very frustrating after this whole thing taking so long AND now having to replan everything my wife and I laid out.

It's difficult to make plans while under this process, you can only basically come up with ideas... I suggest you look into the VR&E program on vetsuccess.gov to help on the educational, vocational and personal business front, this my help with some financial needs.
 
I totally understand!! Same boat man. I cant even Start serious Job hunting until i get a separation date. EverywhereI look they ask me when I'm getting out.
 
Yeah I applied for the VR&E awhile back. When I went to my DVA brief I told the instructor that I did and he told me "there was no way I didn't hear anything back". I showed him the forum I filed online and he didn't have anything to say back. I am a 25 series (Q and U) so there are a lot of opportunities for me. What I am worried about is the length of time it will take me to find something worth taking. Ideal is something federal. My wife was a 25U as well and she now works for the FAA, which is what I planned on doing but the slots here (Auburn, Seattle) just got filled, and moving right now isn't an option. Not really willing to work for anything less than what I make now either.

@Brown exactly man, I've applied and interviewed and they always ask when. I've been told 100 times by my PEBLO and others that "I'm almost done" yet shit still keeps coming up.
 
Ok you need to go to the local VR&E office asap! Tell them whats up, reapply with the same form you submitted before and save a copy of the form. They should set your up with appointments immediately.

They did the same thing to me, mine never made it into the system.
 
Contacted Soldiers Council today. I sent in all my documentation and they said they will have answers within 48 hours. Bump for anyone who can shed some light on this for me.
 
Yes, you can rebut the "revised findings."

AR 635-40, Para. 4-22:

"d. Revised findings. USAPDA, will take the following actions when modifying PEB findings and recommendations.
(1) Furnish the Soldier (next-of-kin or legal guardian) a copy of the revision by certified mail, return receipt
requested. The letter of transmittal will state the reason for the change. Information copies will be provided to the
PEBLO and to the Soldier’s counsel.
(2) Advise the Soldier (next-of-kin or legal guardian) that his or her election or rebuttal to the revision must be
received by USAPDA within 10 days from the Soldier’s receipt of the revised findings unless a request for extension is
received and approved within the same time frame.
(3) Return the case records to the PEB if the Soldier is eligible for and requests a formal hearing or if one is
directed under the provisions of paragraph c(2), above. Processing will be according to paragraph 4–21.
(4) Record the revised findings on DA Form 199–2 (U.S. Army Physical Disability Agency (USAPDA) Revised
Physical Evaluation Board (PEB) Proceedings).
e. Consideration of rebuttal.
(1) After considering the Soldier’s rebuttal to the revised findings, USAPDA will make one of the following
determinations:
(a) Accept the rebuttal; issue new findings and recommendations according to the rebuttal; and forward the case to
USAHRC for final action.
(b) Concur with the original recommendations of the PEB; forward the case to USAHRC for final action.
(c) Adhere to the revised findings and recommendations and forward the case to APDAB.
(2) The USAPDA will inform the Soldier in writing of the results of its consideration of the rebuttal.
f. Soldier’s election to revised findings. The Soldier records his or her election to revised findings on DA Form
199–2, section X. If the Soldier fails to submit an election within the allotted time, USAPDA will deem that the
Soldier has waived his or her right to file a rebuttal and take final action on the case."
