Has anybody had negative dealings with the reserve component MEB personnel? My MEB has been a total CF from day one. My PEBLO gives me paperwork on Thursday afternoons; the paperwork is due on Monday(5 calendar days), so I basically have no time to get any legal advise. The legal counsel they assigned is entirely incompetent... he is never available. The MEB doctor blatantly missed conditions for my NARSUM. I appealed the NARSUM with an independent provider review... that doctor found and documented the condition. The MEB doctor AGAIN missed the same conditions(he didn't even read the entire doctor's report from the IPR). Then, the MEB CO called me on the phone and blatantly lied to me about my MEB. Now, they are stalling so that my MEB has to be restarted due to going over the time requirements. Me feeling is that they want to start over so they can erase their numerous mistakes(there is no other reason for them to do this). When they start it over, I will lose six months of benefits. has anybody else had these kind of problems with the MEB personnel at West Point? My family has already contacted the news... If people thought the VA scandal was bad, wait until they hear about this one. Anyway, just curious if anybody has had similar issues.
 
In my experience as a moderator, many cases have challenges similar to yours. These challenges can be overcome, and typically it takes the assistance of competent legal counsel.

Sorry to hear of your problems. I wish I could say that this is unusual. Unfortunately, many members have problems with getting a correct or fair outcome. Here are my thoughts on your post:

Request an Impartial Medical Review (IMR)/ Impartial Physician Review (IPR)- sometimes the nomenclature is different depending on your service and the servicing MTF. This will buy you more time. Or, just request more time to submit your response. Do so in writing.

Is this MEB Counsel or PEB Counsel? Either way, if you are not satisfied, you can (and should) complain about this OR seek civilian counsel if that will will help you achieve your goals.

Okay, seems like your MEB is not yet finalized. This may be to your advantage as it gives you additional time to respond and to gather additional evidence.

Yes, I have dealt with many cases at West Point....however, the issues are not really "West Point" specific...they encompass many MTFs and are common.

As far as the loss of "six months of benefits," not sure what you mean. Are you not on orders? If not, should you be on orders and have you sought orders? Or do you mean something else?

I will address each of these seperately:
First of all, I have a VA rating of 80%. I am a reservist and am still in... basically, the WTU at FT Drum messed up big time(I'll save that for another time)

I did receive a NARSUM; it had four unfitting conditions listed( I already have a VA rating for those and it would have put me over 30% military percentage). Anyway, the NARSUM did not address three conditions I felt needed to be included, so I requested an IPR. the IPR doc agreed with me and submitted a memo that three conditions should be added/changed. The MEB doc basically did not even read the memo. First line of the MEB doc's reply "addressing the two conditions"... yes he said two when there were actually three. So I end up talking to the MEB CO about three weeks later to address my appeal. He had not even talked with the MEB doc; he went ahead and cancelled my MEB. Of course, when he was talking to me, he tried to make me believe that my MEB was still going forward(unknown to him, the PEBLO already told me he did that).

Why would I lose six months benefits? That's simple, when you start an MEB/PEB a VA case is opened. VA payments are backdated to the start date of your MEB. By cancelling the MEB, they cancelled the VA claim too. I am a reservist and am not on orders. Of course, this should have all been done on orders, but the CF that is the FT Drum WTU messed that up.

Now, the MEB personnel have lied to the IGs office about my MEB. They told the IG that my MEB has been restarted and it has not. I am now filing a Congressional Complaint.

That really bad part is that I have a medical issue that is a potential life threat. The MEB personnel told me if I postponed the surgery, my MEB would continue... another lie from the MEB staff.

So I'm left with waiting for the Congressional and the news media... perhaps if they are publicly embarrassed, something will be done(and it is an election year)

Unfortunately, it seems to me that the MEB personnel have absolutely no integrity and are morally bankrupt. They have no concern for the damage they cause to the welfare of soldiers. Although, it seems until somebody decides to hold them accountable, nothing will be done.
