DA199

I’m currently at 19 years and 4 months.

I Received my proposed rating, but it states on my DA199 that” Soldier should not be separated or retired prior to 21 July 2024.” Now reading this it sounds simple but knowing the military it might not be. Will the Army honor the PEB recommendation?

I’m eligible for retirement after that date. Does this mean the Army will honor the PEB request? I sent a request for legal just in case.

Ask legal but my guess is they will honor it and put your orders out past that date. If you earn a regluar retirement and your VA rating is 50% or higher you automatically get max compensation via getting all of your earned longevity and VA disability. Check with legal and ensure that will happen. Otherwise you can request a FPEB and cancel before it starts to get you over the finish line. Also, there is COAD. I think the PEB is trying to get you there without those steps as it is unnecessary paperwork just to do the right thing:)

This process sucks and not everyone cares but I have found that the PEB at least for the Army does take care of its tenured Soldiers. My wife has 17 AFS and the PEB found a way to give her a tax free pension by giving her a combat related designation for a condition. The funny thing is she argued for it to be on a presumptive condition but the regulations for the PEB are different than for CRSC people. So they gave her a combat related designation for a condition that she didn't request haha!

Regardless of what legal says I would keep an eye on it and save all of your leave. If they try to kick you out before you can request a congressional and this is one of the cases where they actually have some pull with the higher ups.

Lastly, make sure you do everything by the book. Getting a DUI or some other legal issue is the one surefire way to throw everything you have worked for away!

Thank you. The fact that it states it blows my mind. My PEBLO told me he never seen that before. I know I've heard about this but never seen the MEB say it directly. I also have over 50 days of leave. My NARSUM says I have 100% even if they took a few 10% away I'm still looking at 100% TPD.

I don't have to worry about my unit. My command is aware. They told me that if I need anything just let them know. I've been for over 19 years man I'm not going to screw this up by DUI. HAHA!!! I'm going to be on my best behavior.

Thanks just wanting on Legal to get with me. At the end I'm going to make it to that point.

Thank You for the advice.
