Denied ETS extension????

I started my MEB around 21 July 2014 and im currently waiting to receive the call to review my NARSUM with the MEB Doctor. My ETS date is 12 Nov 14. I just received word that my Company commander recommended disapproval for my ETS extension, I understand that it still goes up the chain and that the CG is the approval authority. I spoke with my PEBLO and she pretty much said that Despite AR 635-40 3.7 I could still be separated from the army on my original ETS even though I am in the middle of a MEB/PEB. She said that in that case I would stop my MEB/PEB and exit service and deal with the VA for any disability. I'm wondering if anyone has ever been or knew anyone in this situation. My family and I are very stressed and need any and all the help or information that we can get. Thank you!
 
The key is a determination of medical disqualification. Once that is established it is almost impossible to deny an extension to complete the IDES process. The only possible exceptions would be if a soldier was already on multiple or lengthy extensions.
 
Are you by chance in Hawaii. There have been multiple issues with this issue in Hawaii.

If they fail to extend you (which is possible but is against regulation) I would pursue this through ABCMR. Maybe try contacting HRC? They might be able to assist in this matter.
 
Very strange. The extension should never be in front of the company commander. Hospital commander signs off on the need (form letter, stamped off) and then it goes straight to installation/division retention. Then ETS is updated. I have never seen the process even involve someone making any determination besides the PEBLO initiating it based on timeline and the Soldier agreeing to extend (memo format, no contract). All ETS transactions on the Army side are managed in RETAIN, which means a Career Counselor. Talk to your batallion or brigade level career counselor or self escelate to the command career counselor (installion/division level). If that doesn't work I can get you numbers to retention at HRC who would be interested in fixing this.

AR 601-280 makes it clear there is no qualifications needed for this extension besides the MTF determining the need. It does not involve retention eligibility so zero need for company commander input. Brigade level isn't even notified until after its said and done.
 
Mike, I think this SM denial of ETS extension during active MEB has been frequent in Hawaii. GCMA has been delegated to BDE CDRs and there have been reports of they interpret the extension as their option, as opposed to the SM option.
 
I think that's bull. I re-enlist while I was in Warrior transition so as my roommate in Hawaii Schofield Barracks. Continued my medical evaluation until I was found unfit. Now, they retire me with over 30% with ID card and Medical plus receiving VA pension every month.
