Denied surgery

While on active duty for a mobe I tore my ACL just before I left country. Now I'm at the CRC and the doctor here says that if I was staying at Benning he would do surgery but since I am returning yo my home, reservist, he won't do it. I also have physical therapy for a shoulder injury that should take me to a WTU but now they are saying that since I am on ados orders I can do iron my own through the va. if I don't get the ACL surgery while on active duty I won't ever get it done. It has an up to six month recovery. I don't know about you but I can't just walk away from work for six months and not be orders.
I guess my question is how can I get the army to do what it is supposed to do and take care of my injury. I just need to go to a WTU where I can get the surgery done. Any ideas would be very much appreciated.
Failing that does any one know the process to get the surgery and be put on orders while it is done.
Thanks

Are you in process for a PEB? Because if you are you should have been informed by your PEBLO that you are not allowed to have any "non-emergency/non-life saving" surgery while awaiting your PEB.

Not positive what a PEB is but I'm almost certain I'm not. I am just redeploying from a mobilisation.

A PEB is a Physical Evaluation board. It is the process they put us through when determining Fit/Unfit for continued service and in the Armed Forces and determining what type of discharge you will receive if found unfit (ie separation with severance or medical retirement). If you don't know what it is then you are likely not going through one yet. I do not know much about how all of this is handled in the reserves but if you were injured while on order than I think they should be processing you through for your condition. Your Primary Care Physician said that surgery was not needed or that they would not allow for surgery? If they ran diagnostic imaging tests (MRI, CT Scan, Etc) and determined surgery was unneeded than that is pretty much it, you can request a second opinion via a consult with another doctor but don't hold your breath. Your situation is confusing me and I have to assume it is just because I do not understand the reserve world that well.

Your right I'm not experiencing that board. Just processing back to the reserves. Doc said if I was staying he would do the surgery but since I am refrading I should have the VA take care of it, not likely. I completely tore my ACL so surgery is warranted. And I was active they would do it. Sorry I kind of rambled before.

Ask for a second opinion! Do you have an LOD for the injury? You can press your unit to push an MEB and try and force things. The military has an obligation to fix you, not the VA. It sounds like they are just trying to push you through and clear their plate.

Are you still on title 10 orders?

I you are redeploying at the SRP with the CRC Ft Benning, you can request to have your current orders extended for medical readiness processing. You do not have to go to the VA to get your injuries treated if you have a LOD.

If you are returned to reserve status (i.e. they are not willing to help you) You can request that your reserve unit put you on MRP2 orders and be sent to the WTU for treatment.

I was in a similar situation and was able to get 60 day orders to begin with to check into the WTU with the intention staying and receiving all of my rehabilitation. I started off on the 60 day orders and then the WTU told me they they wanted to send me to the CB-WTU. When the 60 day orders were about to expire i was extended 179 days. They continue to extend the orders 179 days at a time.

Well now they are trying to change my orders to ADME orders but are saying that I have to come off these orders and turn in a DD214. And then wait two to four weeks off orders for the process to go through HRC. I don't like the idea of going off orders. Once that happens I don't think they will do crap for me. And I am getting the LOD also. So that is good. (Active duty medical evaluation)

Dozuki: You are doing everything that you can and should be doing. Getting the LOD is paramount, get the ALHTA notes from the doctors stating that the surgery is necessary to repair the ACL. That will help when you start with your ADME packet.

I was on ADME orders for a little over 9 months so that I could get two surgeries done.

A little unclear on something though, you mentioned that you are coming off of a mobilization. Those orders should be for MRP orders and not ADME orders.

An excellent refererence for you is the WTU Consolidated Guidance. http://www.armyg1.army.mil/wtu/docs/WTUConsolidatedGuidanceAdministrative.pdf

Take care and good luck to you.

They say that since I was on ADOS I have to go through this crazy process to get on the ADME orders. I will be seeing the doc again. My knee gave out on me again, 4th time,
Dcmd124 thanks and what are the ALHTA notes. I have a copy of her physician notes. Is that the same thing?
Thanks for all the help everyone.

ALHTA notes are the electronic notes. You can request them in the Patient Affairs Division.
