“More Than 3,300 Navy and Marine Corps Veterans Denied Medical Retirement Benefits will be Provided New Review of Ratings for Contributing Conditions […] The ruling stems from the class action lawsuit, Springs v. Del Toro, which challenged the Navy’s unlawful practice that denied military medical retirement benefits to more than 3,300 Navy and Marine Corps veterans for more than 15 years.”

Will the Navy look at disability retirees during this time window? What about the other military services? Many retirees were low balled and never got their contributing disabilities combined with the unfitting conditions. A disability retiree rating could be 75 percent versus 40 percent if all of the contributing disabilities were taken in consideration.

Hello,

I read nothing that suggested that ALL disability cases would be reviewed.

“If you are a Navy or Marine Corps veteran who was denied a medical retirement as a result of the lack of a rating for an unfitting contributing condition, NVLSP encourages you to email [email protected] to learn more about this case.”
