double checking disability percentages

I just got my medboard paperwork and getting ready to sign the 3947. I was looking through it at found my ROM from the VA for my spine.
Flexion: 0-42 with pain beginning at 28
extension: 0-8
right rotation: 0-30 pain at 25
left rotation: 0-25 pain at 15
left flexion: 0-20 pain at 12
right flexion: 0-15 pain at 10.

Also I nerve pain still on my right leg, the report says decreased and loss of feeling slight.

I looked at the regs and I was thinking I would get 30% based on the forward flexion, but I am not sure. Does having pain in the lower extremities also count on the percentage. The only other thing I is high blood pressure, that is kept in check with low dose medication.

I received 10% for siatic interference in my left leg. I had ROM numbers falling in the 20% category, and received 20% DOD 60% VA from the PEB, signed my 199 and sent it on its way. the PDA board changed my rating adding the 10% to my failing conditions and retired me. So yes, it comes into play.
 
Forward flexion has to be 15 degrees or less to get the 30% rating... you had pain at 28 so your forward flexion is 28 degrees

I missed this in the looking, I thought this said 30. As this is my lumbar not cervical spine, this is what I am going off of? When did you get the 15 degree for 30%, I just want to make sure I am quoting the correct stuff to the board when I need to. Thanks for you help! Glad to hear you got good results from your PEB. We started our MEB's around the same time and I just got through the MEB. Wishing I was at your point/
Unfavorable ankylosis of the entire cervical spine; or, forward flexion
of the thoracolumbar spine 30 degrees or less; or, favorable ankylosis of
the entire thoracolumbar spine..................................................................... 40
 
I think it depends on what section of the spine - cervical v. lumbar.

Right, for the lumbar spine, 28 degrees would warrant a 40% rating...But, recall that the PEB (or the VA if this is an IDES case- which it should be, but you can confirm whether it is or is not) provides the ratings not the MEB.

The leg pain could be rated (and in my opinion, if caused by the unfitting back disability, should be) under nerve conditions.
 
OP where are you located?

I can tell you that the JBLM PEB will NOT do what Jason mentioned about putting the leg pain together with the back pain, but you can rest easy knowing the PDA will change the PEB's findings.
 
I am in kansas, and this is an IDES. I have to wait for the PEB to determine, I am trying to get an idea and have the reqs read so I know what I need to appeal if needed. I will be going through JBLM for the PEB. My packet just got sent yesterday. Thanks guys for the help! This site has been a wealth of knowledge.
