Ebenifits and TREK questions

So first question- In my ebenifits there is my C& P claim that started back in November. Right now its showing "pending decision approval" since 31 January . Now at the bottom of the page a new "eligibility determination" claim was started January 28 and closed February 5th and an appeal is possible. It also says a letter will be sent for the claim determination. Does this mean the VA has came up with a compensation rating and has finished their part, or do I still have to wait for the other C& P claim to finish? And what is the current wait time for C& P claims to go through the process?

Question 2- if they find someone on the tdrl fit for duty at a later date, do they have to join the military again? I would hate to be out two years and have to sell my house to be forced back in.

I'm not sure about your first question. However, the answer to your second question is: no. You are able to enlist again if you want. I think you have like 90 days to return to duty at same grade and rank if you want. Anyway, the short answer is: no, you are not forced back in.

I have scoured the internet to find information about that "eligibility determination". I don't think anyone really knows what that is (including the VA). Are you still in the military or have you completed the med board and separated/retired? The C&P claim has to finish before they have your ratings done. ebenefits takes a person to update, so they could be done with your claim and not have it updated. Wait times very greatly based on your disabilities, complexities of your claim, and how busy the regional office is where your claim is. If you don't already have one, I would suggest that you get yourself a service organization representative. They will be able to look at the VA's internal system and give you more current information on where your claim is in the process. They can also call the regional office your claim is at and actually talk to the person handling your claim. They will also be able to help you with your appeals and application for IU if it comes to that someday. You will have to sign a limited POA, but it is nice to have someone you can talk to when you have questions.
