80% disability from the VA for a single person with no dependents is $1503 a month. Also, just wanted to say that if you are having problems tracking your case at the VA contact one of your Senators. I contacted my Senator and he has a person that is dedicated to helping veterans with the VA. This person knew exactly what was going on and called the VA representative to Congress to get updates on my case. It was very helpful

Thanks, I will keep keep that in mind. My PEBLO is out this week, I have to wait until next week according to AFPC i'll have my package by tuesday. I'm hoping for PDTRL an as soon as I get my ratings "i will check into applying for IU". Thanks for the info, best of wishes, thanks for your service.

Anybody know how long it takes the VA to make their first payment of disability benefits?
They should make the first payment about 30 days after your official out of service date. :) Of course it could take a little longer depending because we are talking about the VA lol

behiftball,

How did you find out that they needed more evidence for audiology?

It has been some time since I have been on the forum. I am not sure if this is the correct place to post this, but I wanted to continue with the background of the post.

After retiring in March of 2013, I filed for CRSC pay. I injured myself in pre-deployment training during a simulated combat exercise. However, I did not seek medical care until about 1 year after the injury. Everything is documented that the injury occurred during this training. I sent my documents to the Air Force to received CRSC. However, I was denied in spring of 2013. After going through the grueling process of the MEB and all the other issues that were associated with it in my chain of command, I just kind of was sick of dealing with these issues and did not appeal the decision.

I am pretty sure that I qualify for CRSC, but I am not 100% sure of how it works and what the eligibility requirements are. From what I understand, since my disability occurred in simulated combat I am eligible for CRSC. On my official separation orders it states,

DISABILITY RECEIVED IN LINE OF DUTY AS A DIRECT RESULT OF ARMED CONFLICT OR CAUSED BY AN INSTRUMENTALITY OF WAR AND INCURRED IN THE LINE OF DUTY DURING A PERIOD OF WAR: "YES"

DISABILITY WAS THE DIRECT RESULT OF A COMBAT RELATED INJURY AS DEFINED IN 26 U.S.C. 104: "YES"

Also on my AF Form 356 (FINDINGS AND RECOMMENDED DISPOSITION OF USAF PHYSICAL EVALUATION BOARD) it states "DISABILITY WAS INCURRED IN A COMBAT ZONE OR INCURRED DURING THE PERFORMANCE OF DUTY IN COMBAT RELATED OPERATIONS AS DESIGNATED BY THE SECRETARY OF DEFENSE: "NO"

In the remarks section of the AF Form 356 it does state "The SM's injury is considered "simulated" combat training related.

Thanks for reading this far. I know it's a long post.

Do you think I am eligible for CRSC? After being denied almost 2 years ago, can I still reapply/appeal? Any advice?

Thanks,
Phil

I would suggest posting here http://www.pebforum.com/site/forums/combat-related-special-compensation-crsc.11/

I'm not familiar with CRSC yet or any timeframes associated to it. Sounds like you would qualify for it, but I was told by a lawyer that just because the IPEB/ VA determine that a condition was combat related does not automatically mean that the department that does CRSC consideration will determine the same. Again, the link above may be able to better assist you. Also, if you do appeal (again I don't know what the appeal process is like), you should definitely cite the regulations that are used in these forms. (ie 26 U.S.C. 104).

Lastly, here is the AF page for CRSC in case you have not been there before. It has phone numbers and possibly some useful information.

Combat zone is for certain tax considerations, so it being no should have no reflection on your CRSC application.

The problem with CRSC is they need to make their own determination. If you only send them evidence that someone else came to the conclusion that it was simulating combat (or instrumentality of war, armed conflict or hazardous duty) they cannot approve it. You need to send them evidence relating to the event and it causing your injury. They do not have access to your records. I would include the PEB's determination, since it helps you case though.
