How did you go about getting your detailed proposed rating percentages? I called the VA once my proposed rating letter was complete, but the document they sent didn't break down how they got the total they gave me. Who did you talk to?
My PEBLO gave it to me.
 
Update: My wife was able to get combat related designation. Since she didn't request a Formal Hearing but a written appeal instead her VARR request was not forwarded to the VA. So she will sign and concur with the new DA 199 and check the box for a one time VARR to hopefully increase one of her unfitting ratings.
So today makes 4 weeks and a few days since I submitted my written appeal. Haven’t heard anything yet but my PEBLO told me this morning that she can see it was assigned to a review team…any experience with that on here? I’m assuming I should hear something soon based on that right? Fingers crossed.
 
@essexr were you not rated for your TBI?

You and I have very similar conditions, was wondering if Narcolepsy 1 could be considered a residual of TBI? Also have done a few stints at Laurel Ridge for chronic PTSD, which is my referred condition.

70% PTSD
40% Fibromyalgia
10% Left ACL Tear

DOD 100% VA 100%

Requesting formal hearing for combat relatedness and VAAR for Narcolepsy to 100%. I have type 1 Narcolepsy with cataplexi which the events equal a major seizure.
Update: Formal Board results: TDRL to PDRL. Waiting to submit VARR for 100% for narcolepsy. Will petition code 13 for combat related. 2 years in this process. 22 years active Navy service.

During this appeal process trying to get the record straight, are you still on active duty? If so, what job do they have you doing?
 
I am on active duty and mainly doing office work. No watch-standing and half-of days.
 
@essexr which is code 13 as I got 70% for PTSD as well but they claimed that it was not combat related since I had issues in my past even though I had 15 years in the military before with no issues or counseling and then an event that forced me into counseling.

Administrative Law (Code 13)​

Legislation, Regulations, Freedom of Information Act / Privacy Act (FOIA / PA), and Disability Law Branch (Code 133)​

Code 133 coordinates OJAG review and comment on a myriad of legislative items and DoD and DoN regulations, directives, and instructions. Acting as the OJAG FOIA / PA Coordinator, the branch reviews, forwards, and/or responds to FOIA / PA requests and provides guidance and advice to commands on releasing information to the media and other requestors on numerous cases. The branch also processes disability appeals and combat-related disability certifications. Additionally, Branch 133 is responsible for reviewing and coordinating all DoN submissions for the Federal Register and Code of Federal Regulations.

About to apply for SMC L, which has the potential to go to O.
My wife is my caregiver (she gets paid by the VA as my caregiver), which qualifies me for SMC L (aid and attendance.) Suppose you have additional ratings over 50% or a combination of disabilities separate from the disability that qualifies you for Aid and Attendance; In that case, it goes up 1/2 a step to max out at SMC O.

Do the research. It is there. New job a Rater/VSR for the VBA. Who would have known

How did you know you where permanent and total? I just got 100% the other day, but it didn’t say anything about P&T.
 
It said entitled to chapter 35 DEA and disability is considered PT and no further examinations needed

How did you got about changing tdrl to pdrl ?

I was on the caregiver program while on active duty. So no specific disability, but cumulative. For VA Aid Attendance my narcolepsy with cataplexy was increased to 1005 and my PTSD was increased to 100%. Just approved for CRSC.
My mental health issues almost got me fired, However, with good supervisors/coaches and therapy I am making it,
 
Got it, thanks for sharing. Just curious because the VA website doesn’t really mention much about the conditions you mentioned as being qualifying conditions, unless I missed it.
 
Remember PFCAC is different from VA Aid and Attendance. Both go by rating ADL's Assisted Daily Living if that is the acroynm

I know several years have passed, but I'm hoping that you may still frequent the forum and may be able to help. This is the first time that I've heard of cataplectic events equal to grand mal / major seizures. Were you successful with proving this and/or can you provide more information? Also, did you have any issues with the note under epilepsy in CFR 38 that states "Note (1): When continuous medication is shown necessary for the control of epilepsy, the minimum evaluation will be 10 percent. This rating will not be combined with any other rating for epilepsy." - I have read people say that they were rated at the 10% mark because they take medication daily...
