Fort Drum Timeline

I am now one month into waiting for anything on Va.gov or ebenefits to change. No update from my PEBLO other than waiting on the VA and everything is just stuck. This process is draining lol.
Case closed, proposed ratings complete, getting sent to the PEB today or tomorrow, and would not disclose my proposed ratings. Just blessed it finally moved forward ♥️

If the VA offered me 80%, there is a way to try to fight it to get to 100 correct? Or is that it?

Did your PEBLO say how much longer?

Not yet. I do have an Expedite Memo submitted so I am hoping to sign my 199 today or tomorrow. The timelines just vary so drastically that I have no idea. The process is slowly draining me because I have no information about when I will be out and therefore no way to apply for rentals, job offers, and I have had to push my school date back. From what my PEBLO told me the process will not slow down due to the VA needing extra information. Soooooo yeah. I am at a loss. Every time I have asked abut the timeline it always ends with "your case is with the PEB so it depends on their workload and when they can complete your case." Frustrating but I am so close.

Were your proposed ratings in eBenefits? Mine shows one case closed (that I think includes referred condition but its unclear) and one case still open (with everything else). No proposed ratings or disabilities shown in eBenefits either.

So I have the same ones. The 80% from the VA in my case is not official as they deferred 3 conditions that require an extra exam. That’s why they told me I show one closed and one open. However, once the proposed ratings are sent to the PEB, it keeps moving IDES wise. So for me my ratings VA wise can still change after my appointment or after discharge I can request an increase for certain conditions. PTSD is my main focus to increase because the exam was… short and not conclusive. In order to get my proposal I contacted my MSC and he answered me immediately.

Should I interpret eBenefits saying "case closed" for one as meaning that the PEB found me unfit and the VA rated the unfit condition(s)?

I would definitely assume that’s the case. The PEB probably already found you unfit if they requested VA ratings. You should be getting a call soon about your 199

When I did my C&P psych exam the dude barely asked me anything. Took 20 min. When I saw my C&P exam results he disagreed with my PTSD diagnosis even though I have 6 years of documented therapist notes and prescription. Also have a combat related service connected event. The MEB still listed PTSD as failed retention standard on my NARSUM but that C&P exam is gonna screw me with my VA rating, if I get one at all for PTSD. Signed my NARSUM 13 June, waiting for the PEB.

There may not be PTSD checked but what else is checked in other section. And I’m almost certain they’ll be a way to increase it after all you’re the only one who knows what you’re struggling with and experiencing. Just stay confident and don’t lose hope

Did you receive any news from the PEB yet? If so how long was it between sending your signed NARSUM off and receiving unfit memo or 199?

Yep.
3 July- PEB found me unfit
19 July- VA completed and sent my ratings back to PEB
25 July- received 199 and ratings, 50% DOD 100% VA
29 July- received Separation date, start clearing next week, Terminal leave starts 28 August

Was your proposed Va rating and ultimately the “final” rating which you get when terminal leave ends(retirement day) the same?
So 100 proposal and then 100 with the peb agreement ?

So the VA sends their rating back to the PEB and the board takes the VA rating and makes their DOD rating. The ratings you get from that are all "proposed" ratings. However, these are pretty much guaranteed to be your ratings unless you elect a formal PEB because you disagree with the rating decision. Or you suffer another injury/illness between agreeing with your ratings and your separation date. There are a number of unforseen things that can pop up, so the VA won't fully commit by saying FINAL ratings until you are fully separated. But barring some unlikely situation (besides flat out disagreeing with your ratings) your proposed ratings will be your final rating in the end.

However, your rating can change if you are placed on the temporary disability retirement list (TDRL) after you separate. I was placed on the TDRL and have to be reevaluated in April 2023. During that exam if they deem that I have not improved or worsened, then I will be possibly put on the PDRL, permanent disability retirement list. If you are TDRL then the VA can reevaluate every year for 3 years (used to be 5 I believe) before deciding to lower your rating or move you to the PDRL.
