I got rated at a 0% for my ankle but it needs surgery and has gotten worse. I have been seeing my doctor regularly since my MEB Board and believe there is documentation that supports a rating? What happens if I don't sign my findings and ask for only my ankle to be reevaluated or is it the whole process?

Ankle is rated on range of motion I do believe. So the VA did rate it by giving you a zero but determined that it was not bad enough at this time to rate a higher percentage. After you have surgery you may be able to be re-evaluated and get the percentage increased if the ROM gets worse.

On a bright note. Be happy for what you have gotten. 90% is a very high percentage.

are you on the PDRL or the TDRL? if PDRL you are at almost the top rating of 75%. if you are on the TDRL i believe Jason posted on a tread earlier this week that states that you could get the condition re-evaluated. either way i think that you are in good shape.

That's a decent explanation of what they use to rate the ankle. i.e. what evidence you need to show them to get the rating accurate.

As a note, a 20% rating should get you maxed on DoD ratings, at 75%, but the way I calculate it (which may be wrong), even a 40% won't have you max out VA ratings. Its best to know what you may gain by making it an issue. Most do not collect retirement pay so DoD rating isn't as important, but your scenario may motivate you to get the correct rating.

What do you mean when you say "most do not collect retirement pay so DoD rating isn't as important"?

Most circumstances, your retirement pay is completely offset by VA disability pay. If your retirement pay is 1500 for example, and your DA disability pay is 2000, you see 2000 from the VA and nothing from the military, this is why the 30% is the magic number and most arguments for more aren't made. CRSC and CRDP are the exceptions, and of course if your retirement pay is greater than the VA pay.

You made that so much easier to understand! I found more information on this site than the regulations, the PEBLO, and ADC put together!
