I recieved my decision from the PDBR. They increased fibro from 10% to 20% but then said headaches that had a 10% rating at discharge was connect to the 20% fibro so they changed it to a 0% and didnt change my type of discharge. I thought they couldnt lower anything? They also stated that the other things could also be caused by the fibro so they couldnt be rated because that would be "pyramiding". Any suggestions. i submitted my case in Aug of 2009 just for ttime frame.

When you were discharged what was the findings from your PEB/MEB, what did the VA rate you after you had filed, and finally I am sure Jason will provide advice on the next step if any.

I was rated 10% fibro, 10% headaches, 0% IBS/Diverticular by the PEB. The VA rated me 20% fibro, 30% Headaches, 30% IBS 6 months after discharge. The PDBR changed fibro from 10% to 20%, lowered the headaches from 10% to 0% and 0% for IBS because they stated were caused by the fibro and would be pyramiding the disabilities. That left my total percentage at discharge unchanged at 20%.

PMIO369, I would say you need to hear from Jason and LTC Parker on this. Off the top of my head this is not pyramiding as both of these are two distinct conditions. Secondly, you are correct the PDBR should not lower your original rating either they will keep it where it was or increase it. If you are truly within the time frame I would talk with Jason about fighting this in court. I am sure others will comment as well on this, most of my experience is on the VA side of things as I too am going through the PDBR (still learning about this).

I believe what they did is wrong given the VA ratings. Unfortuantely, PDBR results are final and the next step is federal court. I would love to read your PDBR results so I can speak about this problem in the many venues I used to expose problems with the military disabilty system. Send me a PM if you would like to share your PDBR results with me.

Perhaps Jason can chime in on your federal court options.

Mike
