Has anyone been declared "unfit" by the informal PEB, them appealed to the formal PEB and found "fit"?

I am considering this for myself and wondered what input you all may have. Thanks!

I saw it happen for the Sailor, however the FPEB told the JAG their intention, so she dropped the appeal and accepted the UNFIT--Separate with Severance Pay.

The reasoning was a lack of evidence in treatment of the unfitting condition.

The same board members found me UNFIT and recommended PDRL. Their decision is based on the evidence presented.

How long did it take from requesting a FPEB to getting your results?

FPEB requested 21 March.
FPEB notification 21 April.
FPEB date 1st week of May.
FPEB stipulated to add some (not all requested) conditions, however enough to qualify for retirement. PDRL. DOD % is pending VARR. Since I agreed, the process required no testimony from me.

According to the JAG, this happens about 10% of the time. According to him, typical FPEB results is 2-4 weeks following the hearing. Add an additional 6 weeks for VARR.

Ahh. Okay. Did you go through the entire formal board, or did they come to an agreement before the actual hearing?

They said that one of my unfitting conditions was pre existing (not true) and they said that my shoulder was fitting, which is also untrue. My goal will be to have them rate my PTSD, find my shoulder unfitting, and potentially my back as well.

I'm hoping I don't have to actually do the formal hearing, and they agree for the most part, to my stipulations.

They presented the stipulations to the JAG just prior to the hearing. I did agree & I still had to go into the hearing, but it was only 20 minutes or less. All I had to state was name, SSN, duty station and a few yes and no sirs. No testimony was necessary.

Oh : / I was told there is a chance I may not have to go to D.C....Ugh. That sucks. I really don't want to go

I was told that too. It just depends if they get enough info in time and a chance to look at it.

Those of you that have gone to DC for the FPEB, how long did it take to get your results back? I just had mine last week and I was wondering how long I'd have to stress over it this time. *sigh*

Hello,

What were you MEB conditions and what did the VA and DOD rate them? Also I assume your goal of the FPEB is to have more added to get a higher % or get RTD. What is your goal?
