Help!!! Please!!! JASON?

How can that be so? when I had no rating whatsoever. I didn't have any rating for it to be 0%. This is my first rating ever.

If it was your first rating ever then it only backpay's you to the date you file the claim with the VA for the condition. I thought maybe you have claimed it before and it was deferred or rated at 0% and that was the reason for my previous comment.

My major issues were claimed Sep 2011. Cleveland stated they did not receive them until Jan 2012, even though it was done through ebenefits online. I was repeatedly told by the VA to hold off on claiming my other issues until I received a rating.

I held off until May 2013. It was 3 weeks after my additional claims that the VA finally started "gathering evidence". They did nothing from Sep 2011 to May 2013.

Well, it's all done and said now.

I need to know how to get my taxes back, because my whole DoD check has been counted as income even though it was for a disability. Which affects my taxes and applying for SSDI.

I guess I know have to decide to apply for IU or get my last couple of conditions that were not on my claim added? Or maybe both?

I would do both unless you feel the conditions not added can get you to 100%

I'm not sure about getting taxes back for DOD, Jason, Ranger or Maparker can help with that
 
Amy, you did apply for VA when you were leaving the AF didn't you? I thought you were in the "Benefit Delivery at Discharge". You should have gotten back paid to the time you got out.

I would also start checking on why it wasn't back to at least Jan of 2012. If I remember correctly, don't they skip a month after you are out? She got out the end of Nov 2011, so wouldn't Jan be the first month of pay?

That was the date they had on my claim the whole time in ebenefits. Jan 2012. And when they closed it, they changed it to May 2013.

I applied first in Sep 2011 during my TAPS, a month before I got out.

So I found the break down of my ratings:

PTSD- 50% 11/01/11 combat related
Fibro- 40% 11/01/11
Right Upper Radiculapathy- 20% 11/01/11
Cervical stenosis- 20% 11/01/11
TMJ- 20% 4/12/13
Thoracumbular sprain- 10% 11/01/11
PCOS- 10% 4/12/13
Migraine/TBI- 0%
GERD- 0%
Anemia- 0%

Not rated- Tachycardia, ulcers, surgical scarring, Thoratic outlet, Scapular dystrophy

How is my Migraine/TBI 0% when my PTSD states residuals of traumatic brain injury (cognitive impairment)???

Since my PTSD is deemed Combat related, what do I do to file for CRSC and what would 50% be?
 
Amy, when the VA provides you the ratings, they typically give you the justification of how they came to the percentage and what needs to be met to achieve the next higher rating.

A zero percent rating is not a denial, it just means they acknowledge the condition exists, however there was not enough evidence to warrant the next higher rating above zero percent.

Look at the rating for the Migrane/TBI and see if you have the documentation needed to meet the standards they are looking for. If you do not have the documentation and the conditions are still present, make sure you are beating treated by the VA for the conditions, you can then file an additional claim for the condition.


Continue to drive on and get them to rate the TBI/Migranes. Find yourself a good physiatrist in the VA system, they will get you the correct testing and physical, occupational and social therapy.

The difference between the 90% you are currently rated at and the next higher percentage of 100% is over $1100 per month.

I will definitely get my records in order.
I was sort I of bummed that they rated my IBS with my fibro. That with my migraines/TBI would have made me 100%.
I had an awesome physiatrist before I got out, who I saw monthly.

I just started pain management. Is that considered the same thing through the VA?
 
Does anyone know if I have to file something to get my Dod pay changed to VA pay to make it tax free?

There are so many forms for everything. It's so confusing...

They should automatically do a lot of this for us when we are qualified, but that would make sense and cost more money.

VA will do an audit automatically once DFAS gets a VA waiver from the VA, and then you will be backpayed

I do not get back pay. My VA is $20 less than my DoD pay. But the tax free will help. I need to find out how to collect my back taxes for the last 2 years also.

My rating has gone through. However, on my ebenefits it is showing that my benefit summary letter states $0 for my current monthly award amount.

But my benefit verification is showing the correct amount.

I was worried I needed to do something on my end to fix it. Sometimes I feel like the VA says: yes you qualify, but now figure out on your own how to get it.
 
I certainly agree with that. I know I complain to much but why so many mistakes especially after waiting so long. Do these mistakes count against the VA for their accuracy or do they just blow it off? I try really hard not to look at e-benefits or worry about the time frame because it will drive you crazy. I wrote a letter questioning my VA errors and submitted it and somehow it turned into an appeal even though my knee and TDIU is being addressed now.

This is why I believe that this process never ends.
