Hi,

I have a short notice request for some info. I had 4 back surgeries and and also lower radicular pain. Codes 5241 and 8620. PEB gave me 40 for 5241 and looped my anxiety and pain disorder into it. The problem I have is the zero for the radicular pain. I have no feeling in my right foot and ankle. My NARSUM states Severe not medically acceptable.

I am really confused because my 199 is due in tomorrow. I have one attourney tell me that because I got permanent I should take it. The JAG I spoke too said I have a shot at increasing my percentage but then I take the risk of loosing permanent. How can the same people say one day it is Permantent and temproary the next? I am so confused and think maybe I should just take waht I got but I just feel I deserve more because of the suffering I endure everyday and my future has been forever altered. Any help you can give me I would really appreciate. Also ROM is 0 degrees flex and 5 extension.

Welcome to PEB Forum! To really give an informed answer, I need more info.

What did they rate each code at? Did you get 40% for back and 0% for neuritis?

Did they recommend TDRL or Permanent Disabilty Retirement List?

How many years of service?

All that aside, remember, the formal PEB is not bound by the informal PEB's decision. They can raise, lower, or keep your recommended rating the same.

Ok, the "permanent" means PDRL, so you are already 40% PDRL. Take it and run. There is absolutely nothing to be gained unless you are over 20 or damn close to it.

The VA will take care of the remaining evaluations and ratings.
