How does the dual process work?

Hey all, hope all is well!

Here's my backstory. 15 years, O4, active army.

18 months ago I was arrested (misdemeanor). Not going to get into the details of that, but eventually when I get my day in court I'm confident it'll be favorable (COVID seriously delayed that).

It was an alcohol related incident so I went to SUDCC, subsequently diagnosed with severe chronic PTSD and after a year of treatment proceeded into the IDES. Still getting treatment through Intrepid Spirit (great program by the way). All QTC appointments complete, just completed the NARSUM, I think I'm waiting on my MEB counseling which should be any day now.

The Army was holding off on any legal actions until the Civilian side was complete. They must've gotten tired of waiting. I was recently issued a GOMOR. In my rebuttal I stated I've been advised by my legal counsel not to discuss the case because it's ongoing. Well, the rebuttal wasn't much help as it is now being filed permanently.

I'm reaching out to TDS for options, but wondering what is the process? What to expect? From what I've read - and roughly explained by my BDE CDR (I've got a good relationship with him btw) - I'll be dual processed. However, I've read (possibly misunderstood) that the IDES process stops.

Anyone educated in this area?
 
"Once a GOMOR is filed, the Army can use that information to file either a chapter action or a show cause board to have the soldier separated from the Army permanently."

"Per AR 635-200,
"1–33. Disposition through medical channels
a. Except in separation actions under chapter 10 and as provided in para 1–34b, disposition through medical channels takes precedence over administrative separation processing."

I know each case is unique but even any information you provide is helpful and I appreciate it.
 
I have read about GOMAR extensively. My wife's coworker got one and so read up on it since I was unaware of what is was. There isn't much you can do to appeal it or try to contest it. The bar is lower because a GOMAR is a letter of reprimand and there is no discipline connected to it. It's mainly a career killer because a GOMAR almost always prevents you from getting promoted. When I mean the bar is lower to get a GOMAR I mean that by saying the Officer deciding the outcome is deciding it based on the preponderance of the evidence.

If I were you I might want to try to get through IDES as quick as possible especially if you are expecting to get a 30% DOD rating or higher for medical retirement. Also, consider an attorney. There is a lot going on in your circumstances and an attorney can help you navigate IDES & legal to hopefully get you the best possible outcome.

Thanks! I understand that a GOMOR is administrative and can be easily given out without much evidence at all. I'm engaging the legal channels to see what I can do.
 
I’m curious how it turned out for you if you’re still around here. I feel like I have the same exact story. Wondering what your CG decided on.
 
I wanna say the GOMOR is the punishment. Especially if it’s filed permanently. They could’ve chaptered you but did not. Since the GOMOR was issued and filed permanently I believe a QMP board would then be able to recommend you for separation.
