Is there a set amount of days the Army has to give you to prep for a formal board? It does not seem right to show up a day prior and try to win a fit for duty. My formal is 17 Aug and I have not heard from JAG yet.
Your soldier counsel should be working your case before you report to the board. Dont wait for them to contact you. You will never get more than one day before to report to the board.
I was in contact with my rep well before my formal board. Emails, phone calls and text throughout the whole process. With more time a week prior our first meeting. Then the whole day prior to the board. There are plenty of time to prep but you must do a lot of the leg work yourself. present you case to the counsel.
But remember this with new conditions you are presenting. If that is your only condition that is being referred, do you think that FPEB will still find it unfitting?
If the VA rated me 50% anxiety disorder, NOS with depressed mood, mild memory loss, do you think I have a chance of having this added as unfit condition?
The formal will look at your performance evaluations and the statement from your commander. Do they indicate that you couldn't do your job because of the anxiety disorder?
What I'm saying is if your performance evals and commander's statement don't show your anxiety disorder rendered you unfit for duty, you have to build your case. Get statements from your squad leader or platoon sergeant, get statements from physicians saying how that adversely affects your ability to perform your duties (being specific about the duties). You get the idea.
I'm tracking Sir. Just a little late in the game for me to do that. My board is 17 Aug in DC. I'll be in DC tomorrow to prep with legal. I did find a case in the ABCMR where a Soldier was found fit for duty for cervical fusion due to she had no neck pain subsequent to her cervical fusion and she was able to perform her job (which is what I have been doing with out pain). Plus the doctor that did my surgery recommend that I have a P2 but some how the Army didn't have that in my records and found me unfit for IPEB. I did not get a P3 until the day my NARSUM was ready to be sent to DC, which was a year after my surgery.
Well I'm done. Fit For Duty:
FPEB 17 Aug 12 07:30 ( fit for duty - Reason P3 was not given until Feb 2012. The nuerosugeon recommended a P2 but was a civilian doctor so my PCM Doc had to put it in the Army e-profile for me. I used a P2 for almost a year, which showed I was fit for duty. Plus the board could not figure out why or who recommended me for MEB. My MTF is not the greatest. I was told several times that cervical fusion is automatic MEB but my Chain of Command did not initiate it nor did my PCM Doc. My commander recommended retain. My PCM Doc changed 3 times in the last year so maybe that's where the ball got dropped but not my problem now.
BIG 20 here I come. I had 21 yrs 9 months total - 16yrs 9 months active with 5yrs Reserve/NG, so I wanted to be found fit for duty.
I notice that the FPEB board(for IDES in DC) did not have a full copy of your medical records so use that to your advantage( you may know something they don't which may help you in a formal)
If you really want to win your case I would go with a civilian Laywer( just from my experience with my JAG). She basically did what I do when I have to brief a general. Have my staff go over with me the brief with courses of actions then go brief it. I took a week of PTDY and went to DC and did research(research this board) and did a time line of event which the board will ask you to do. By Army Reg(not sure about the other Branches) you get a minimum of 3 days to prep for the board. I spent an 1hour 1/2 with my JAG out of the 4 days prior to the board which was friday morning 07:30.
Just my two cents may not work the same for everyone.
