Referred for CRPS (Complex Regional Pain Syndrome) after injury during Non-lethal weapons/unarmed self defense re-cert (I was the trainer injured by student) on 22 Sep 2023, and surgery 25 Jan 2024.

Time in service: 13 years, 8 months.
 
Nice to hear December timelines are being finished up I was submitted 23 Decemeber and still waiting on VA rating.

Not sure how you managed to get your severance pay not being recouped. In 2019, I was separated due to failure to select for O-4 and the VA had beeb trying to recoup that money since then after I was rated 90% VA disability in 2019. Would you mind pointing me to that instruction that differentiates between severance and involuntary sep pay being recouped or not being recouped?

It's specific to medical separation pay. If your DOD% can be subtracted from your VA% and still leave you at 100%, then you can recieve both. They just exclude the VA% for those specific conditions so your are not being paid for the same thing twice.

Alternately, if your DOD condition is combat related, they will not recoup.

So, if my VA overall percentage is 100% P&T, but my by the numbers percentage is 330% and my DoD% is 80%, I can receive both disability pensions?

The "by the numbers percentage" has nothing to do with it because that's not a real calculation of anything. If you were to take away all the conditions included in that 80%, and rate only the remaining conditions, they would have to still put you at 100%

Also that wouldn't apply since you get retirement at 80%, not Disability severance. You have to be less than 30% dod to get Disability severance

FPEB 16 Apr 2025: Board agreed to raise DOD to 30% prior to the hearing based solely on the evidence due to the overwhelming amount of evidence I submitted. The board still convened for 7 minutes so I could swear in and accept their findings.
Granted combat related for all conditions and placed on PDRL.
