I’ve been accepted in school in the state I’m moving to and I asked my PBELO about submitting it but, he told me that I’m a soldier first (although I can’t deploy with my unit) and that I should have told my first seargent that I wanted to go to school. I’m not sure why and what that means. I signed my Narsum on October 5th and proposal on October 19th. Just waiting on the PEB and I’m not sure why it’s taking them so long when the VA only took 2 days. I started my MEB process January 2021. Anyone has advice or can shed a lil light I’m all ears. Thank you.

I can offer the view of a retired senior NCO. Whoever told you that you are a soldier first was correct. On the other hand, I believe most leaders would be understanding and possibly facilitate your plans.

This reminds me of a situation a lifetime ago. I told a separating soldier to be at a formation at 0800 hours on a certain day for an awards ceremony (Army Achievement Medal in her case). Everyone was at the formation, including the commander, but she had chosen to travel to Frankfurt (Germany) a day earlier, without asking or telling anyone. Her award was revoked.

In the U.S. military, insubordination is covered under Article 91 of the Uniform Code of Military Justice. It covers disobeying lawful orders as well ...

There is a common myth that for an order to be lawful, it must be preceded by the words, "I am giving you a lawful order."

You should be able to submit an expedited memo if you have been accepted to a school. If your PEBLO won't do that, then you should get in touch with the ombudsman.

As your CoC and RonG said, you are a Soldier first. Despite going through an MEB, you have an obligation to fulfill and if you're looking to pursue education, it would be best to make your Command Group aware and obtain their support. I too have had Soldiers like Ron mentioned who "did what they want" and it did not turn out in their favor.

I recommend getting the support from your chain.
 
I signed my 199 on Monday and currently waiting on my orders. Thanks to all for the advice. I did have to call my ombudsman and founded that my peblo sent the wrong soldier’s information and the PEB was waiting a lil over 30 days for him to respond.

I am at Fort Hood as well. The VA sent the decision letter on Nov 28th. It is currently almost the middle of Jan. Is there a max limit of days waiting? PEBLO says no updates, wait for the army proposed ratings
