Went with my husband to see the lawyer this morning. He was looking over my husband's MRI's and I mentioned some things he didn't see on the report. I found the MRI report I was referring to and showed him. Apparently my husband has MRI reports requested by Va and MRI reports by his PA. The ones his PA requested and the ones requested from the VA are different! The VA MRI report has less information on it. It doesn't include everything. The report was also done by the same person on both MRI reports, just done 2 days apart. His lawyer asked it would be ok to show it to some other people. Of course, we said "yes, go ahead". So glad his PA requested another report or my husband would have definitely been screwed. The laywer also told us to get my husband's PA to request another ROM from somewhere else and to ask for all we can, until he says no. He said that once they find out his PA is helping him out a lot, someone will tell his PA to stop, because of the "political issues" regarding the MEB. His NARSUM is full of contradictions, it's ridiculous.
 
MRI's are usually only helpful (but marginally) in showing unfittness...ROM is where it is at for rating purposes. An ACCURATE exam of ROM (taking into account functional limitations due to pain, lack of endurance, incoordination) is the key to a correct outcome. So many ROM exams do not meet the correct standards.
 
We want his neck and back added to "does not meet retention standards". As of right now, it's just his shoulder than "does not meet standards". So, the correct MRI report is definitely beneficial. The lawyer also explained the ROM as you did in parentheses. We highlighted a lot of contradictions within the ROM results and the report. The lawyer could not believe everything that just did not make sense.
