MEB Mental Health

*Update*

PEBLO told me yesterday VA has finished their ratings an i should get DOD ratings back next week. Then orders about 2 weeks later. She couldn’t tell me my VA rating though. Who can I call to find them out? My anxiety is through the roof I’m ready for this to be over with.

Yes, the providence regional office who does ratings for MEBs...usually they can fax your ratings. Unless they are nice enough to give it over the phone.

No answer lol
Log in to either ebenefits or vets.gov go to the "disabilities tab" if the claims are closed your ratings will be there if not go to claims-work in progress- to see what stage they are at.

Hello all just found out I’m being placed on TDRL. How long do individuals stay on this for? Should I fight this? I honestly just wanted to be medically separated with severance an be done.

So if you are on the TDRL then you are at least 30% DoD. It is not always true, but VA ratings are usually higher. Personally, I was discharged with severance and I wish I had been retired. Now, 14 years later, it has been reviewed and I am being retroactively retired. My warning about the severance pay is..... If you file for and get VA disability pay you will have to pay back the severance pay. I didn't receive my VA pay for 4 years because instead of coming to me it was going towards paying bay my severance. So to get out and start receiving disability pay, being on the TDRL may be the fastest route.

Did you get a DOD check while on TDRL? I’m stressing because I was told two different things that I would an wouldn’t. Idk how I’m going to support 3 kids on just 1300 a month from the VA

The huge question mark is, will you get a DoD check concurrently with your VA check. From what I have learned through this process you can only concurrently get both checks in a couple of circumstances.... If you have 20 years active duty completed or if your injuries were combat related. Other than those circumstances, I do not think you will get both checks. Of course, I am feeling my way through this so I am far from an expert!

No, you only get the VA check make sure you add all your dependents as well you get extra money for that. 1300 will easily qualify you for SNAP benefits I would really take advantage of that with three kids and 1300 you would qualify for about 800+.

That is true in most instances. However, there are cases where the VA offset does not cause a complete waiver of retired pay. The retiree keeps the residual.

For those eligible for CRDP or CRSC, that residual may reduce the amount of either of those payments.

I'm writing a federal lawsuit on this topic asking for declaratory and injunctive relief I strongly disagree with dfas and the dod interpretation of these laws when applying them to Chapter 61 retirees who are retired based on a percentage disability only i will post to the group when the final revision is complete.

Good luck (sincerely).

Actually there are circumstances where you can get a service check and a VA check during TDRL.

For a percentage retiree with less than 20 years of service? I'm not aware of any circumstance that allows it.
