MEB/PEB PENDING: VA DISABILITY QUESTION

If you retire with a Medical Discharge (over 20 years of Active Service) ILO Lenght of Service Retirement, can you still get VA disability Payments?

AGR, over 22 Years of Active Service, pending PEB rating.

I am at 55% right now. I COULD do better going through PEB. I understand you get the higher of the two percents.

Is there an offset IF you get a Medical Discharge VS Lenght of Service retirement.

Yes, you would be eligible for concurrent receipt (CRDP) due to the fact that you have more than 20 years of active federal service (traditional guard/reserve who serve 20 years of reserve duty are also eligible at age 60).
 
The reason I asked Jason is that there is so much information on the Interent. Some sites say IF you get a Medical retirement (over 20 years of Active Service) VS Regular Retirement, there is an offset.

What do they mean when they say " You cant receive BOTH " " Miltary Disability Payments and VA Disability Payments" ?

Was that the OLD law?

Hard to say what other sites or people are talking about. But, the criteria for CRDP is 20 years or more of service and a VA rating of at least 50%. I have posted the citations to the law, regulations and various agency materials in a few other posts. If you are interested and can't find them, let me know, I will link to the earlier posts.
