MY UNIT SAID AN (MEB) SAID I NEED TO SIGN MY DISCHARGE PAPER WORK AND THAT I DON'T QUALIFY FOR A MEDICAL RETIREMENT. I HAVE A 80% RATEING FROM THE VA AND 6 YEARS ACTIVE 2 YEARS M-DAY AND MY CONDITION IS AGGRAVATED BY SERVICE IN AFGHANISTAN. I DON'T THINK THEY ARE CORRECT. PLEASE HELP.
THANKS, BIGJOHN

Bigjohn,
Sorry I can't answer your main question. I am just wondering how you already have a rating from the VA if you are still in the Army. This is not the first time I have seen someone refer to a having a rating while still on active duty.
How did you go about getting a VA rating (if anyone else knows how to do this, please chime in as well)
Sorry not trying to hijack the thread, just a little curious.

Kingkevindavid,

Going by earlier posts, BIGJOHN was referring to how much time he has accumulated as active duty time, not that he is currently on active duty status.

BigJohn,

Question. Did your unit decide upon an MMRB or an MEB? What was the outcome of either of those proceedings? Are they asking you to sign discharge paperwork because your term of service is up or for another given reason?

If it was an MMRB, the options should of been return to duty, probationary period of duty, reclassify mos, or refer to MEB.

The MEB should be a listing of conditions that meet/fail retention standards.

BIGJOHN,

I have been working on a number of cases where Reserve and Guard units have been improperly stating that members who fail retention standards for in the line of duty conditions must be discharged. If this is your situation, please contact me, either by Private Message, or by using the contact us link.

Hello Jason, yes I am on blood thinner and will be for life. They say I can appeal but I wont be able to stay Infantry so why fight the discharge? I just want to keep my benefits with a medical discharge. We all earned them. Any help would be apprecieted even if to educate my state (S.C.).
Thanks, BigJohn

BIGJOHN,

If they are separating you after an MMRB, this is wrong. They should be referring you to an MEB and later a PEB. The reason to fight this is that you may be eligible for benefits, possibly immediate military retirement. A side note, I have seen several States informing members that the only appeal is to a non-duty related PEB to argue for fitness. Though they put it on letterhead, or have it signed by high ranking officials, they are still wrong.

I just fought this out in another state. Though, initially, all the people I spoke to stated that they were correctly separating members after an MMRB, I addressed the issue to the State Surgeon and the Adjutant General and got them to change their position. I think that this erroneous processing of cases is a pervasive problem. Contact me by PM if this is what they are doing to you.

Hey Jason,

What would u tell CO on what u r looking for in regards to the MMRB?
Only 4 possible decisions right
1...meb
2...reclassify
3...probationary period
4...fit..which could lead to discharge
You know saying you want an MEB will/could send up flags to most.
I dont want to say reclassify. Thats a bad position to be in.
I can continue to do my job but dont want CO or anyone in the food chain get the wrong idea.
My first thought is to say I want to be fixed. But then wouldnt probationary possibly be the choice at the MRRB.
I dont want anything I say be used against me.
I feel a pyhsician or state surgeon will refer me to MEB but what the CO states is given weight as well

Please give m your advice

JACK
