Migraine MEB

I am currently going through a MEB for migraines caused by a deployment in 2015. I am just curious to see what everyone's outcome for the same condition has been!

Hmm, I see that you received a DoD 0% proposed rating for your "migraine" PEB-referred medical condition and concurred.

To that extent, what was the DoVA D-RAS' determination for awarding the aforementioned VA proposed rating; just out of curiosity?

It was said that they were headaches and not migranes, said i had a fainting spell and not a seizure
 
I claimed migraines, the army said it wasn't unfitting, but they left it at migraine. I will be curious to see what the VA comes back with on mine. It quite frustrated me that the DOD considered it to not be unfitting, but they're debilitating...

I was medicated for awhile but I stopped taking them bc A, they didn't really help much, and b, I'm really awful at keeping up with prescriptions... Actually part of my boardable claim. I was amazed and incredibly agitated when I received my NARSUM and saw that DOD wasn't going to give me anything for them. Those bad larries last for days and I can't leave my blackened scentless room.

Indeed, I am sadden to read this albeit if you disagree with the DoVA D-RAS' determination then upon receipt of the DoVA official ratings decision letter, you can submit a DoVA NOD appeal within one year of the dated VA decision letter.

To that extent, if your DoVA NOD appeal grants a VA 30% rating or higher for your PEB-referred unfitting condition, then you can submit an application to the appropriate military appellate board requesting a military disability retirement; if that's your ultimate expectation. Take care!

Warrior664 let me see if I understand for the condition the I had been PEB-referred unfit then I already out of the army and VA grants me after re-evaluation 30%. The DoD grants me 10% when I signed the 199 so my question is Can appeal to the army after I already out or before get out?

Can I go back to the VA and file a claim for the Migraines since the DoD did not award me anything?

If you are still in the military going thru the DoD IDES MEB/PEB process and a VARR was successfully granted in the PEB phase with an increase to any PEB-referred unfitting condition, then the DoD IDES PEB must adopt that new VA proposed rating at that point in time and generate a revised DA Form 199.

If you are no longer in the military then your status has officially changed to a military disabled veteran. As such, if you received an increased VA disability rating of 30% or higher for any PEB-referred unfitting condition via either a DoVA NOD appeal (submitted within one-year of dated VA decision letter) or a request for a VA rating review reconsideration (a faster option upon receipt of your VA decision letter), then you could submit an application to the appropriate Military Branch-specific appellate board requesting a military disability retirement. Indeed, yes albeit please ensure that the medical evidence and/or medical documentation for your migraine symptomology supports the appropriate criteria as annotated within the 38 CFR VASRD.

Also, it's probably a very good idea to start a "migraine diary" and include those results with the submission of any additional medical evidence and/or medical documentation at the time of your VA disability claim. Take care! :cool:

I had a migraine diary when I went in front of the formal board and it helped amazingly. They added my migraines as unfitting without a single question. Still waiting on % from VARR however.

I should have also stated that included in my 2 year long migraine diary, I also included what meds I took that day and also attached the discharge notes after everytime I landed in the ER or urgent care.
 
My MEB just got started two days ago for migraines.
I have seen nurologist for months, and they even sent me to behavior health to see if it was from something else where they diagnosed me with anxiety. I have passed out 5 times since all of this began, went to the ER 3 times, got put on 5-6 different medications and nothing has helped so they are finally starting my MEB. I am looking for advice with the steps I will be taking through it, and also what ratings I should be getting. I am not entirely familiar with how getting an MEB works so I am looking for some advice!

Welcome to the PEB Forum! :)

In retrospect, since the DoD IDES MEB/PEB process is a performance-based system, one important factor is the impact of all medical conditions affecting the military service member's ability to "reasonably perform duties of his or her office, grade, rank or rating."

Each military department's first priority for military service members suffering from an illness or injury is to ensure delivery of the highest quality and proper medical attention. If the medical conditions improve to the point that the military service member is able to return to full military duty, then they are returned to their military unit.

Otherwise, despite the advances in modern medicine and the best efforts of patients, some military service members cannot be returned to full-duty status. In this event, it will be necessary for the military service member to be referred to the Integrated Disability Evaluation System (IDES). The IDES process begins whenever the military medical provider determines that the military service member's ability to continue their military service is questionable due to a physical and/or mental impairment.

To that extent, please remain "positively proactive" when progressing thru the DoD IDES MEB/PEB process! For sure, never default acceptance to any injustices; fight then continue to fight some more until receipt of your desired expectations supportive via medical evidence and/or medical documentation!
