I served from 2005 until 2011, with a 15 month deployment to Iraq in 2006-2007 where I was wounded and recieved a purple heart. I PCS'd shortly after post deployment and was set to deploy again with my new unit. During the pre deployment health screening they instructed me to go to the TBI clinic and was subsequently placed in a WTU and was told I would be medically retired more than likely. Up to this point I had never had so much as a counseling statement and had been promoted with waivers for every rank. 4 ARCOM, 4 AAM, Good conduct medal etc, I was on track to make E6 in 6 years.
A week after getting to the WTU I was given a permanent profile and was non deployable and the MEB process was started. I was having major sleep and PTSD issues and was placed on meds. After a few months the side effects of the meds was making it almost impossible for me to wake up and was causing severe mood swings. I missed a doctors appointment because I was asleep and my wife was unable to wake me up and I received an article 15.
A month later it happened again even though I repeatedly asked to have my medication stopped altogether or altered. I received a field grade article 15. At this time it had been nearly a year in the WTU and I had completed my phase 1 and phase 2 physical and was told it may be another year.
My wife and I got into an argument while she was attempting to wake me up and I threw her off of me while I was in bed. I woke up and came downstairs and she began hitting me and throwing things. I called the MPs and she lied and told them I hit her, they arrested me and released me to my unit.
I requested to go to inpatient treatment to get help while awaiting the PEB and was told it would be a few months before I could go. 2 weeks later we got into another argument and a neighbor called the MP because of yelling. She was attempting to leave with my daughter and the MP pulled up while she was sitting in the car, I pushed her arm out of the way (in front of the MP) and attempted to unlock the door so I could get my daughter out of the backseat due to the fact her mother was intoxicated and was not safe to drive.
I told the MP she was trying to drive drunk with my daughter and she got furious. She then proceeded to tell them I choked her which was a complete lie (as corroborated by a witness that was there the entire time) I was again arrested and released to my unit. A few days later I went to inpatient for a month and upon my return was informed I was being chaptered under 14-12 with a General under Honorable discharge. My MEB/ PEB was never completed.
I am 100% P&T through the VA and have all documentation for everything I have stated. I moved on with life but am highly considering applying for an upgrade with BMCR to have it changed to a medical retirement. I was discharged in 2011 and have all of the proof that a multitude of regulations were intentionally broken or circumvented. Would it even be worth the effort to have it upgraded? Not sure if I would be eligible for any increase of pay or anything since everything is combat related but the real motivating factor is just for them to validate that what happened was plain wrong.
Even in the separation packet, it was annotated multiple times that I "qualified" for a 5-17 discharge although I had been diagnosed and was receiving treatment for PTSD for almost 2 years at the time. Dual processing never occurred.
What do you guys think, is it even worth the trouble?
