Just a little background, I am an M-Day soldier in the Michigan National Guard(since June 2015). Previous to that I was active duty from Dec 2010 to June 2015.
Feb 2020- I am informed I have arrived at a MRDP as well as considered a Non-Duty Related (NDRPEB) case because I have no LODs for my injuries, even though my injuries are sustained while Active Duty. I fight this at every step and elect to fight to stay in. I am aware I will be found “Unfit” but I am simply trying to let the board know at every step my injuries ARE in fact duty related.
May 2020- Unit reaches out to me to let me know my NDR-PEB is moving forward and I should get my affairs in order to be discharged within 60-90 days. At this time I also submit an “Intent to File” through a VSO.
Aug 2020- The informal NDRPEB meets, finds me Unfit as expected. I submit a final rebuttal that I should be going through the IDES process along with final documentation from my civilian GP that my issues are duty related.
Sept 2020-Oct 2020- Radio silence.
24 Nov 2020- I am contacted by my unit Admin NCO that, after an in depth records review, I will now be going through the IDES process.
Dec 2020-Feb 2021- Radio silence
22 Mar 2021- PEBLO at Camp Atterbury reaches out to schedule initial counseling
23 Mar 2021- PEBLO initial counseling
24 Mar 2021- Mandatory legal brief from Soldier’s Counsel
31 Mar 2021- VBA Case Manager reached out for mandatory brief.
2 Apr 2021- Sent in 21-686, sent to JBLM same day
6 Apr 2021- QTC calls to schedule C&P exams
18 May 2021- Last QTC exam
26 May 2021- MEB Findings forwarded to me by PEBLO. Of my 3 referred conditions 2 are considered to not meet retention standards.
27 May 2021- PEBLO Counseling on MEB findings and Form 5893
1 June 2021- Office of Soldier’s Counsel appointment. Attorney suggests I “Concur” and ballparks my ratings and disposition. I return Forms 3947 and 5893 to my PEBLO. PEBLO informs me my packet has been sent to the PEB and expect a disposition in 60-90 days.
9 June 2021- Routinely checking my bank account, I see a large deposit from the VA pending.
10 June 2021- Reached out to both my VA Case Manager and Soldiers Counsel to see if they can shed some light on how my VA case moved through so fast, as I have not received my decision letter or any correspondence from the VA at all.
Will update as things happen.
I just want to say that if you’re in a bad spot regarding this process, whether that’s a unit that isn’t doing the right thing or your being made to go through a NDRPEB, even though you can prove it’s service related… keep fighting for what you’re legally and ethically entitled to. I thought it was a wrap last year in August and look at my situation now. Turn in everything you can to make a strong case for yourself.
