I am happy for 90% for combined rating. I am just worried, I claimed 13 conditions and got 90%, my way of thinking may be inaccurate, but with 90% I feel that VA may have rated my MDD low, maybe 30%



Here is my thinking:



I was already rated for sleep apnea at 50% before all of this. If you add in, even a couple 10%s plus a hopeful at least 60% rating for MDD, would likely be 100%, instead. Maybe the rated me at 30%, we will see. MDD is my unfitting condition.



Any thoughts?

I have no idea on any of that stuff, where did you get your rating though?

So the way the math works is you 60% of 100...... Then 50% of the remaining 40..... And then 10% of the remaining 20....and so on.

Look at what they put on your DBQ in tricare online and you'll be able to see almost exactly how you were rated, cross reference it with the 38CFR Disability Ratings.

Man it feels like I’m never going to get anything official from the VA or my PEBLO.

My PEBLO told me that I’m just awaiting “Findings” from the PEB but didn’t say if the VA gave proposed ratings. My case was sent to DRAS on 09MAR23.

VA is very slow, PEBLO won't give you proposed ratings until you have findings. You'll have to call VA hotline.

I did this and I was emailing my MSC today and he said "THEY WERENT SUPPOSED TO GIVE YOU THAT PLEASE WAIT UNTIL YOU ARE CONTACTED!!!1!" lol

The one thing that has seem constant is that the PEBLO's have no idea what they're doing. I'm sure there are a lot of good ones, but i've seen a lot of horror stories on here. He is completely wrong. The VA actually MAILS YOU A COPY prior to getting your findings. As soon as they close them they snail mail you the paperwork. I got mine a week before I got my findings.

Called the VA hotline. Still no news. God this process suuuuuuucks. The hotline was like “You’re in the decision phase.” I’ve been in that phase since March. VERA didn’t call me for my appointment with them.
 
Does anyone know if the DOD rates only the referred condition or both the referred and claimed? I'm still on active duty and going through the MEB. I requested a formal PEB because the claimed "CLAIMED" PTSD was rated as 50% by the VA but DOD shows it as "meeting AR 40-501 retention standard". I cannot find any resources that shows it the DOD rates both the REFERRED and CLAIMED conditions. My PTSD truly supports that it is NOT meeting retention standards per that AR. Did they do this because my PTSD was a claimed condition versus my shoulder which was my referring condition? Any help is greatly appreciated.

Referred just gets you in the door but no guarantees. The NARSUM make recommendations on if fit or unfit. The IPEB usually agrees with NARSUM and concludes with the same findings.

If IPEB found that the condition is fit then what you are really challenging is that it should be unfit through a FPEB. Whatever the VA rates an unfitting condition the DOD% will be the same. If the condition is found unfit but the % is not right you request a VARR. In this example you would request a VARR because you believed the condition should have been rated 70% or 100%.

It may be late in the game but I would look to hire a dedicated private IDES attorney to help prepare and represent you at the FPEB. Depending on your branch you may have 2 shots at it since branches such as the Army will allow your attorney to send in a written response in advance of the FPEB and many times they will accept and make the changes without needing the FPEB. If they don't then your attorney will get feedback on where you are weak so that you can be prepared for the FPEB hearing.

These are great information to read. I have 24 years of service with 20 being active duty. I received a 30% rating by DoD and 100% rating from the VA. My fight is with the DoD portion. On my DA3947 showed PTSD as retainable. I now have BH temp profile and currently attending a civilian IOP for MST and combat. I didn't have these when my NARSUM was completed. Will the FPEB take these records and reconsider? I hope that makes sense what I have posted.
