NARSUM Findings back....Jason need your help!!

I finally got my NARSUM back and after reading it throughly VA found the above ROM for my Knee that im getting boarded out for. Well no where on the army findings have they included ROM. So i was wondering if would it be a problem when PEB makes decision?

Jason since you have dealt with so many cases in your career would be able to guess my percentage and if i would be fit/unfit? Your input would be highly appreciated.
 
The PEB is going to determine what conditions make you unfitting. If it's your knee, then the percentages assigned by the VA will be applied. I assume your NARSUM indicates you have knee problems. If the ROM test wasn't completed by the MTF doc, then I would simply write a rebuttal to accompany your package or ask for an impartial review; ie 2nd opinion. With a knee injury, ROM is going to have a huge impact like the back, but it may be hard to achieve a high % based solely on ROM. Make sure if you have nerve damage or any other symptoms/conditions they are addressed as well.

Keep in mind a lot of people will look at a thread, but not post unless they have something they deem helpful.

What does the VASRD say about your ROM? Have you looked around for threads about people with similar ROM and what they received?

When you indicate "No where on the army findings have they included ROM." Can you please clarify?

*I assume you have attended you VA exams and been seen by an MTF provider who wrote your NARSUM. Your concern is the NARSUM, which will be forwarded to the PEB, doesn't include ROM measurements. Do I have this right?

I think this is because we thought that you were addressing Jason. From the looks of your attachment, it looks favorable for a fit finding (only based upon the attachment and ROM numbers, the notation that everything is within limits (WNL) and the fact that a repetitive ROM was accomplished and no additional degree of limitation was noted). Just my opinion. I don't know if you are wanting a fit finding or not.
 
I had ROM issues with my ankles and these were documented and included in my NARSUM. Only issue was while the military did a very good job meausuring and reporting an accurate ROM for both feet, the VA did a sloppy job and marked everything for my feet WNL. This was one of my unfit conditions, and even though the discrepancy was noted on my NARSUM stating that the VA doc did not accurately portray my ROM, when it came time to be awarded my prelim ratings, you bet the VA went with their doctor's WNL for my unfit condition. I was awarded 10% but based off of my ROM from my military podiatrist, I should have been awarded at minimum 30% and that is without taking into consideration the bilateral affect. I didn't fight this and go to a FPEB, but am fighting the VA rating. So, with that said, you need to make sure the VA has accurately documented your ROM the first time. Now I get to wait probably for a year to get a new rating once I am out next month.
 
well thanks for your replies everybody... but the attached ROM were done by VA and my right knee is WNL but my left knee isn't...
