Need a second opinion or guidance on taking FPEB or getting out

Hello!

I thought I saw something on here before about if you are 100% VA then there is a special circumstance where the VA won't recoup your severance pay (Not including combat related benefits).
Is this true? or did I make this up in my head.

I was rated at 20%, and don't really want severance and would rather have retirement, but, I don't really have time for delaying this process. Half of my stuff is out of the country and I'm paying double-rent...I was fully expecting DOD to be over 40%. I know if I appeal I'd likely be increased, but you never know...

Edit: My PEBLO says that my referred condition's % will be subtracted from my overall VA percentage. If I'm still at 100%, I don't pay back the severance. Is this true?

If you hit 100% combined VA without the referred DOD condition then you shouldn't have recoupment as you are still 100% disabled.

So, in a way I’m lucky to have not gotten the 30% mark? I reach 100% 3x over. At over 10 years service as an e6 id get around 50k after taxes.

If I was 30% I’d pretty get nothing special compared to the 100% va benefits?

In a situation where you're getting severance you are very lucky because you don't have recoupment. however, a medical retirement would let you have Tricare for life versus VA healthcare. I believe Tricare is superior to VA care especially since you have flexibility with Tricare.

At this moment due to an offset there isn't a financial gain for getting a medical retirement. You don't know the future though and it's possible in the future that the law changes and you're able to get both. If that's the case you're going to probably regret getting the severance over a medical retirement due to an increased monthly income from getting both your pension and your VA disability at the same time. There is no right or wrong choice. You just have to know all the scenarios and be good with whatever happens afterwards based on your decision.

I got the same rank and time so you should be getting around 65k after taxes if you are past the 10.5 mark. And you can get the taxes back if you didnt already know so 87846 is roughly what you should get

It’ll be pretty tight to get to 10.5 but hopefully I can squeeze it out!

You are never guaranteed that the VA 100% will be forever….stranger things have happened…I personally like to have a safety net…which your military retirement would be the safety net in case at some point in the future the VA lowers your 100% to something much less. In that situation, your military retirement would kick in, assuming your military retirement is more than your “new” VA percentage.
 
If you’re 100% P&T it won‘t change to my understanding. The laws can change (like Sleep Apnea changing from 50% to 10% soon) and as long as your claim was determined prior to change you are grandfathered at the original % granted.
