New and need some advice

My name is Jordan Hall and I have been in the Marine Corps for 3 years and been on a MEB since April 2017 for scoliosis. On November 2014 I was doing a CFT and during the ammo can lifts my back just totally gave out on me and I could not move anymore. After that, my back has been in pain every single day every second of the day. It effects my sleep, my mood, and my mental state. I am an Admin Clerk and can barely do my job because of the pain.

Anyway, move forward to Aug 30th when I was found unfit for duty and October 6 2017 I got my ratings back. DoD found that it was a pre existing condition (which I found out I had at MEPS) and was not aggravated by service, but VA decided to give me a 60% rating, that includes my sleep apnea.

I am trying to get some advice on if it is even worth appealing. I feel that it is because I never felt pain all my life (which I have had a civilian doctor got my cleared because MEPS requested I get measurements of the curvatures and the doctors advice) up until 2014 November due to a CFT basically ruining my life, also I was allowed in with a spine that pretty much looks like a question mark, and it is pretty obvious that it is service connected.

Please if anyone can help me, I would be grateful.
 
Hey man, I was a marine for a long time. Can I recommend that you talk to your PEBLO and get the number of the lawyer who represents you? They might have the most legit answer.

I would get an attorney. It is hard to imagine your condition was not aggravated by service.

Im in Oahu and experiencing a totally different issue, is the lawyer a JAG or is it a civilian and therefore costs mucho $$$? Also where would I find a PEBLO?
 
Attilathescott, are you a Marine or Sailor and in the PEB process? If so, your PEBLO is located at the Pearl Harbor Makalapa Naval Health Clinic, if you're a Marine, your PEB lawyer is Mr. Mielke who is a retired Marine JAG Lawyer and his office is located in Washington State, he is a government contractor so there is no charge for his services. Be advised that he has over 100 clients so it may take him a week or so to get back to you but HE WILL get back to you. Prepare your questions for him prior to calling. Let me know if you need more information.
