NG IDES/MEB question.

So I tried searching and only added to my confusion:

Back story: 22 years Army NG, being MEB’d for 2 conditions caused by a vehicle roll over about 2 years back now while on IDT.

Already had a VA rating from other LODs prior(93 percent combined, rounded to 90). The two new conditions caused by the LOD are not yet rated and were examined as part of my SHA part B. Received my NARSUM on Dec 19th, it’s currently with JAG to correct some minor typos(they have another soldiers social and DoD number on the forms) but with VA Seattle since Dec 9th. IPEB found both conditions unfitting and recommended for PEB.

My PEBLO is telling my that since the referred conditions to the board were a direct result of the LOD from the vehicle roll over and since both have been found unfitting, that I would qualify for CRDP for my first cycle after being chapter 61'd out. Meanwhile, JAG is telling my CRDP wouldn't start until age 60. So I am confused.

Assuming a DoD rating >30 percent, who's correct in this scenario?

JAG is correct - CRDP will start only after you reach your age of qualification (usually 60), and you apply for it. Reservist CRDP does not automatically start once you reach your required age. Your PEBLO is likely thinking you are an Active-Duty Soldier.
