Hello,

I'm a new member to this group which looks like there is alot of helpful people here. So here is my situation. I was place on a MEB/PEB which expires next March (2026). I currently have 24 years of sat service, almost 17.5 AGR time (rest was Air National Guard DSG time) and close to 7000 total points. How would this work if I got medically retire with less that 20 active duty time. Would I get a medical AGR retirement? Will I get both VA and Medical retirement pay? Sorry this is so new to me but my unit hasn't been the most helpful.

Do you have a 20 year letter? Just curious because that is your backup even if you have to wait a long time for it.

I would try to stay in if possible. Nothing is guaranteed if they put in you in IDES. If your referred condition that is service connected isn't rated 30% or higher you get kicked out and would have to wait to collect your retirement until you reach the age to retire in the Guard. If you have 15 good years but less than 20 good years you get issued a 15 year letter if kicked out and then you get to collect at the age you qualify for the Guard but with a 15 year letter any money you get from the VA would offset your earned retirement.

So basically if you are AGR and close to hitting 20 AFS I would do everything I could to stay in and finish to retire regularly. If you medically retire immediately due to having a 30% or higher total DOD% any money you get will be offset by any VA compensation you get. My wife was AGR with 17AFS like you. She was medically retired and maxed out at 75% DOD and she still lost out on $1,500 a month compared to if she had completed her 20 AFS. Luckily she qualified for CRSC after she retired and was able to recoup that money she lost. The issue is that getting CRSC isn't guaranteed and if things don't go your way you could end up losing thousands of dollars a month for life or until you reach eligible age to rely on your 20 year letter for the Guard.

Also, I always recommend an attorney. Being AGR you are away from an AD base usually and are out of the loop. Having a dedicated private IDES attorney can make all the difference in the world! I will send you some references.
