PDBR Pay ?

My package is FINALLY going to the board for a hearing. I have a question...
I am rated at 80% from the VA, while the USMC only gave me 10%. I have been out since 2004 and I had to pay back a severance of $22000 to the VA upon my departure.

My questions are here: What happens when I am rated at 30% or more? Do I receive a separate payment from DoD, or does my VA one cancel that out? Do I receive retro pay from 2004 (almost exactly 6 years) to the date of my discharge, and do I receive my severance back?
The reason that I ask is because this could pay off all of my surgeries that I had to get while out of the corps.

Please help!
 
I believe you can only get one (VA) or the other (DOD) unless the injury happened in a combat related environment. Plus, I would rather stick with the VA because its tax free money.

If you don't mind me asking what you were MED BOARD for? And what's the breakdown of your VA rating to get 80%???

My injuries are combat related.
I was PEB for Sinus Tarsi Syndrome on my Left Ankle.

VA =
40% on Left Ankle
20% L4/L5 Degenerative Disc Disease
10% Depression
10%C4/C5 Discs

I have been this way since 4 months after discharge.
Worst case scenario is that I get my severance pay back as I would be medically retired, right?
 
To be "medically retired" you must have 8 yrs of active service in order to receive a pension, blue ID card and all the same privilage as one who did 20 yrs. Pls correct me if I'm wrong, thanks!

If the PEB findings (from VA) are => 30%, then you should be retired. This rating is independent of the VA rating. The VA rates all medical issues. The ratings from the VA are looked at by the PEB and ONLY the unfit conditions are awarded a percentage. In other words, each condition found must prevent you from performing your duties (deployment, job tasks and fitness). I have seen that if you are only unfit for PT but can do your primary duties and a deployment will not hinder your abiility to do your job in an austere location, then you can be put on a permanent waiver.

An E-1 recruit can be medically retired on the first day of service if they were injured in the line of duty and were evaluated and cannot meet medical standards (found unfit). They would be rated the same way as anyone else (MEB/PEB) and if they were => 30%, then they would be medically retired as an E-1. Their retired pay would be very little compared an E-7 with 18 years in.
