Hi Guys
I’m currently currently waiting for the PEB is review my case and give
Me my ratings, I’ve been going through the med board process for Months now and according to my Peblo I should be getting my rating by the end of next month. My command on the other hand has started an adsep process due to pattern of misconduct. I brought it up to my Peblo and he said that my medical will go through regardless and usually with a case as fast as mine is so far it should be completed soon before the admin sep board . My question is what should I expect ?
 
If you are able to truthfully and medically opine that your pattern of misconduct is due to service-related disabilities, you may have a shot.

However, what I specifically mean by this, is, as an example - not showing up for duty, but medically one is able to show this was due to a severe migraine episode that caused the member to miss roll call. Another example would be irritability and lashing out at a superior, but can be medically shown to be a symptom of PTSD or Depression.

I was arrested for alleged DUI early this year that got completely dropped in court, but I accepted the NJP because I didn’t want to be on legal hold and fight it in court martial because it would take a long time. My pattern of misconduct is basically being late for some appointments and PT. I have been getting treatment for depression for well over a year now tho. My command didn’t disclose much about the ADSEP my ssgt just said that the command started the process but my command is still aware of my med board since they sent out the NMA and stated I’m unfit for my job due to injuries and they also stated that they no longer need me. I’m already almost done checking out with the unit and turned in my CIF since I’m only waiting for my findings and new EAS date. So I don’t know exactly what’s going on, whether I’m going to get out with a MED sep or if they’re going to try to hold me so they can start the Adsep board which they haven’t even said anything about it yet

I just want you to be aware of what you risk with an ADSEP; a whole host of benefits could be thrown out the window, and you will have even further issues if your DD Form 214 states anything other than honorable. It is a nightmare for veterans; it will be next to impossible to receive the much needed care you would need from the VA.

This isn't legal or medical advice, but I would most certainly have medical documentation for all symptoms, whatever prescribed medications and their side effects, and have detailed documentation showing, medically, how this is impacting your work and social capacities. Make sure you position the Medboard first and foremost as your sole focus in life, next to fulfilling your duties to the best of your physical ability.

The benefits are simply too great to lose. Keep yourself on the right track and best of luck.
