PEB requesting police report that doesn't exist

Good Afternoon,

So I'm being medically boarded for PTSD stemming from an armed robbery and subsequent self defense. The PEB is requesting a police report, yet there isn't one. The police officer who responded told me to just go home, because he knew how crazy commands could be, and didn't want me to get "hemmed up" for defending myself. In hindsight, I should have insisted on him including me in the police report.

Anyway, the PEB suspended my case and requested a police report. My MEBLO told me to get a Line of Duty determination. I did that, and they replied they still required a police report. I wrote a memorandum explaining the situation and why there is no police report and sent that off. Haven't heard yet if they'll accept it or not.

Has anyone encountered this situation?
 
Could I have them drop the PTSD stuff and just evaluate my fitness based on my ortho/urologic issues? I just want to be done and out already.

I'd hold off on that for right now. If you recant the claim, they are going to wonder why. It could potentially bring up a question of malingering.

Obviously this is a difficult situation right now, I recommend that you go see the folks at behavioral health, they can work with you on reducing your current anxiety and stress.

As such, please try not to make any uninformed decisions which could result in unfavorable outcome(s) taking years to potentially rectify! :eek:

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer!"

is there any kind of defense council for you 3moose1 there has to be. call your local base legal office to find out about it it's their job to give you answer's its probably best to make an appointment there should be a specific office for these cases. on top of that don't be afraid to ask for help I've done it many times myself and for me it made me feel like a normal person that's just stressed and working on getting the information i need to move on. They will ask you 1000 times if you are thinking if hurting yourself or other's and it sounds crazy but just be honest because the law is on your side for what they have to do to help you and your family that they will not if you are in that situation and they don't. you have all the resources in the world available to you while you are military that you might not have or will be harder to get as a civilian . i made that mistake myself and thankfully i made it out ok because of my own support structure. Don't go through these stressful processes alone It's too much for one person to go through. I personally talked to family to stay with them on terminal leave to get back on my feet but there are a lot of other resources if that's not ideal for you. I am getting set up with the VA's vocational rehab program in about a month to start learning new skills for a job after my leave is over. there is a silver lining.
 
I'm meeting with my RCC tomorrow, and he's going to call the WWR PEBLO and see if he can get any information. If that doesn't work, I'm going to ask him if he can set up an appointment with the IDES attorney.

I'm just frustrated. I didn't do anything wrong, but my case is suspended. When I asked my PEBLO about it, he asked what I was going to Court Martial for...I told him I wasn't in any legal trouble, they were just reviewing my case.
 
Talked with the WWR PEBLO, and my case was unsuspended on Feb 29th, and sent to the VA. What does that mean?
 
That the VA will be rating the case, then sending back to the PEB. More than likely you have been found unfit and will be medically retired or separated with severance.
 
So they wouldn't have sent it to the VA if I wasn't found unfit, right?

How much longer do you guys think? God, I feel so much more fucking relieved.

I'm pretty sure it goes to the VA either way. The VA will rate the case based upon the compensation and pension evaluation that was performed.

According to the official timeline, you should have six months or less left.
 
for me it was about a month from when the PEB sent my package to the VA to when i got my ratings/signed. BTW this is what i did anyway, go schedule your TAPS transitional GPS class if you can for me it was a week off work for transitional training, resumes, ect. For Air Force call the airman family readiness center, i think for marines its family readiness officer's. dont know what the other branches call it
