Physical Disability Board of Review Update

I was seperated medically (retired) at no fault of my own. I served 22 years both active and reserve time combined. What can I do a bout getting an army rating. They did not give me a ratinG. They "forced" me to retire or they'd put me out. I was already serviced connected prior to retiring through the VA. What can be done about my military reitement? I need a rating to take that medical condition to the VA.

Jwilliams61735,

I've watched your video. You did a very good job explaining what has happened in your life over the past few years. Servicemembers and Veterans who see your video will take solace in the fact that someone else has experienced 'it all'. You put a very human face on the trials and tribulations of disabled Veterans, I think this will draw a curious eyebrow raise in our direction. This is a great thing you've done, thanks for having the courage to put it all out on the table.

I appreciate the warm feedback and appreciate your service for our country as well. I'll keep everyone informed as to how this all goes. God Bless.

Big Will,

I am really impressed that you set up a website for veterans to vent. I saw your video and what they DOD did as far as the PDBR is bulls@@@. You should be able to fight this, this is not ok. Also check out my post I asked you a question about on opinions for medical opinion and tell me what you think.

Finally something. Here is the situation. I was med board in aug 2006 for right hip pain , ptsd and mojor depression. I got 10% for the hip and 0% for the other two issues. Currently I am 100% from the VA for unemployability.

Got a letter from Dept of the Army today. Here is the verbatim.

"I accept the recommendation of the Dept of defense PDBR to constructively place you on the TDRL at 60% disability for 6 months effective the date of your original seperation with severance pay and then following this six month period recharacterize your seperation as a disabilty retirement with the combined disability of 40%. Enclosed is a copy of the boards recommendation and record of proceedings for your information."

there is a lot more but that is the important stuff. I was only hoping for 30% to get tricare form my kids. I guess I have to wait to see how all of this shakes out as far as repaying the severance money and about double dipping.

So Guntruck,

You got 40% retirement then? Congrats brother!

Also was this from the Secretary of the Army? You said you got that letter and he agreed with the PDBR...did I get it right?

Did you get anything from the PDBR directly?? Or did this just fall in your lap?

I see that you received 10% for right hip pain. What was the actual diagnosis for your hip problem. They are saying mine is snapping hip syndrome or something. Because there are no fractures of anomalies. Im just wondering if im likely to get separated for the hip pain too :)

Number? What do you mean by number? When I asked my peblo last week she said I was 10th in line for my packet to be reviewed. Is that what you meant

hey gun truck congrat bro, on getting a retirement from the pdbr, i have a couple of questions, like what was your pbdr dockett #? and is there any other information in the letter, or package from the pdbr board that is not personal , that you can share with us(the veterans) who is waiting to recieve some sort of rating from the pdbr? again congrats on the retirement, you DESERVE IT,MISSION accomplish

I didnt receive anything from the PDBR. The letter came from Dept of the Army, Army review boards agency. My docket number was 008. This came as a surprise. My hip diagnosis started out in Iraq as a bilateral hernia. I flew to germany and they said it was a torn groin muscle. I was evaced to the states. Final diagnosis was a labral tear in the right hip socket. Surgery failed to correct the problem so I opted for the med board instead of having another surgery.

There was a letter in the packet from the president of the PDBR.

"In accordance with 10 USC 1554(a) and in compliance with DODI 6040.44 the PDBR convened on June 9, 2009 to review the disability rating accompanying the medical separation of (my name) from the United states army. After carefully reviewing the application and medical separation case file, the PDBR recommended the records be corrected to reflect the covered individual was placed on Temporary Disability retired list with a disability ration of 60% for a period of 6 months (IAW 10 USC 4.129); and upon final disposition permanent disability retirement with a combined disability rating of 40% rather than 10%."

the letter from the army was dated september 28, 2009. the letter from the pdbr president was dated august 11, 2009.

Congratulations!!! You must be so relieved and happy. Best wishes to you and your family. Enjoy your retirement, YOU EARNED IT THE HARD WAY!!!!

Congrats! Finally good news for at least one. Hope you enjoy thanks for the info and your service to our country.

guntruck,

I appreciate the information. I have docket 5, so I have been waiting as long as you without any word. I am sure you are relieved like wilson said. Quick question. Did it have any information about how your retirement will be dealt out, considering you already received severance pay? Curious, because I figure others will be in the same situation. Thanks.

Obie

Thats interesting! Because I had my PDBR dated August 9 and recieved the PDBR stuff first, and I have not received anything from the USAF in agreement with the PDBR recommendation....Im wondering if they rejected the recommendation or are reevaluating it..I hope so. Congrats though gun! You definately earned it..Have a cold one for me!! LOL..

The accepted DOD PDBR recommendation has been forwarded to respective army agencies for required correction of records and to the US DFAS and accounting service to make the necessary adjustment to your pay and allowances. These agencies will provide you with official notification by mail as soon as the directed corrections have been made and will provide information on your retirement benefits . Due to the large number of cases in process, please be advised that it may be several months before you receive notification that the corrections are complete and pay adjusted.

Interpret how ever you like. Since I did get severance and have been paying that back to the VA at $225 per month I have no idea how this is all going to wash out.

If anyone has a clue please let me know.

Thanks

Hammer
